Section 4: That this Ordinance shall not become effective until the <br /> realigned roadway described in Paragraph 3 is constructed, inspected, and <br /> accepted by the City of Everett by the proponents/petitioners of the street <br /> vacation according to City of Everett Design Standards, and <br /> Section 5: That if any provision of this Ordinance shall be declared <br /> unconstitutional or invalid by any court of competent jurisdiction, it shall <br /> be conclusively presumed that this Ordinance would have been enacted without <br /> the provision so held unconstitutional or invalid and the remainder of this <br /> r. <br /> Ordinance shall not be affected as a result of said part being held <br /> unconstitutional or invalid. <br /> Section 6: That all monies derived from the sale of the above-described <br /> right-of-way vacation shall be deposited in the City's Real Property <br /> Acquistion Fund. <br /> Section 7: That upon fulfillment of each and every condition recited <br /> herein, the City Clerk shall record this Ordinance with the Snohomish County <br /> Auditor. <br /> i <br /> WILLIAM E.
