1 ORDINANCE NO. /- /23 — r' <br /> 2 <br /> AN ORDINANCE amending the exemption section of the Massage Parlor <br /> 3 Licensing Ordinance, Chapter 24, Section 2 of Ordinance No. <br /> 295-74 (Everett Municipal Code 5.96.020) and repealing <br /> 4 Ordinance No. 1341 -87. <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1 : Chapter 24, Section 2 of Ordinance No. 295-74 (E.M.C. <br /> 7 <br /> 5.96.020) which reads as follows: <br /> 8 <br /> 9 Exemptions. <br /> 10 The provisions of this title do not apply to: <br /> 11 1 . Persons giving massage treatments or baths in a <br /> private residence or a nonprofit bona fide charitable <br /> 12 private social or athletic club not open to the <br /> public generally; <br /> 13 2 Athletic coaches or trainers affiliated with public <br /> or private educational institutions or athletic <br /> 14 organizations; <br /> 3. Students enrolled in schools of massage performing <br /> 15 such practices of massage as are incidental to their <br /> 16 course of study. <br /> 17 The provisions of this title shall not apply to massage <br /> treatments given in any hospital , duly licensed nursing or <br /> 18 convalescent home, or by physical therapists duly licensed, who <br /> treat patients only upon written prescription of a licensed <br /> 19 doctor of medicine, or by any other person licensed by the state <br /> to treat the sick, injured or infirm, or by any nurse under the <br /> 20 direction of a person so licensed. <br /> 21 Licensed beauty operators and barbers who perform only such acts <br /> of massage as are customarily given in beauty salons and barber <br /> 22 shops for purposes of beautification only are also exempt from <br /> the provisions of this title. <br /> 23 <br /> 24 is hereby amended to read as follows: <br /> 25 Exemptions. <br /> 26 The provisions of this title do not apply to: <br /> 27 A. Persons giving massage treatments in their private <br /> 28 residence to members of their immediate family; persons <br /> giving massage treatments as part of a non-profit research <br /> 29 program; or persons giving massage treatments in a bona <br /> fide non-profit charitable private social club or a bona <br /> 30 fide athletic club not open to the public generally; <br /> 31 B. Athletic coaches or trainers affiliated with public or <br /> private educational institutions or athletic organizations; <br /> 32 <br />
