f• •ORDINANCE NO. /67554f f AN ORDINANCE providing for the vacation /realignment of a portion of the alley west of Colby and north of 41st Street. WHEREAS, the City Council of the City of Everett, did by Resolution No.93 7, duly adopt and fix the 9th day of December, 1987, at 8:30 a.m. , as the date for public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described alley were heard and discussed; and WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the alley which is vacated; and WHEREAS, the City Council finds that it would not vacate the alley could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said alley resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: That portion of the alley in Block 11, Climax Land Company's First Addition to Everett, according to the plat thereof, recorded in Volume 4 of Plats, page 21, records of Snohomish County, Washington, lying Southerly of the folowing described line: Beginning at the Westerly corner common to Lots 26 & 27 of said Block 11; THENCE, S 890 59' 22" W along the Westerly projection of the line common to said lots a distance of 6.83 feet; THENCE, Southerly along the arc of a curve, an arc distance of 16.54 feet, the radius center of which bears N 63030'38"W a distance of 65.00 feet, to intersect the West line of said alley, and the terminus of said line. ALSO, the alley in Block 11, Plat of South Park Addition, according to the plat thereof, recorded in Volume 7 of Plats, page 43, records of Snohomish County, Washington. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance.
