ORDINANCE NO. //. 4419---0 AN ORDINANCE providing for the vacation of the portion of 24th Street between Hoyt Avenue and Colby Avenue and the south 100 feet of the alley in Block 489, Plat of Everett. WHEREAS, the City Council of the City of Everett, did by Resolution No. a96,9 , duly adopt and fix the 17th day of February, 1988, at 7:00 p.m. , as the date for public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street and alley were heard and discussed; and WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the alley which is vacated; and WHEREAS, the City Council finds that it would not vacate the alley could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said street and alley resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. That the following described right-of-way: That portion of 24th Street within Block 489 from the westerly margin of Colby Avenue to the easterly margin of Hoyt Avenue, and that portion of a 24 foot wide alley abutting Lots 17-20 inclusive and 13-16 inclusive in Block 489, all as shown on the Plat of EVERETT recorded under Volume 3 at page 32 on file in the office of the Snohomish County Auditor. Be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. I I
