ORDINANCE NO. //. 4419---0 <br /> AN ORDINANCE providing for the vacation of the portion <br /> of 24th Street between Hoyt Avenue and Colby Avenue and <br /> the south 100 feet of the alley in Block 489, Plat of <br /> Everett. <br /> WHEREAS, the City Council of the City of Everett, did by Resolution <br /> No. a96,9 , duly adopt and fix the 17th day of February, 1988, at 7:00 p.m. , <br /> as the date for public hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing <br /> and determination of said resolution has been given by the City Clerk in the <br /> manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, favorable statements <br /> and objections to the vacating of the herein described street and alley were <br /> heard and discussed; and <br /> WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in <br /> the alley which is vacated; and <br /> WHEREAS, the City Council finds that it would not vacate the alley <br /> could it not retain an easement; and <br /> WHEREAS, it now appears to the City Council of the City of Everett <br /> that the said street and alley resolved to be vacated should be vacated <br /> pursuant to the terms and conditions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. That the following described right-of-way: <br /> That portion of 24th Street within Block 489 from the westerly <br /> margin of Colby Avenue to the easterly margin of Hoyt Avenue, <br /> and that portion of a 24 foot wide alley abutting Lots 17-20 <br /> inclusive and 13-16 inclusive in Block 489, all as shown on <br /> the Plat of EVERETT recorded under Volume 3 at page 32 on file <br /> in the office of the Snohomish County Auditor. <br /> Be and the same is hereby vacated pursuant to the conditions set forth <br /> in this ordinance. <br /> I I <br />
