ORDINANCE NO. /4/cfcr-a <br /> AN ORDINANCE creating a special fund entitled, "Laurel drive Landslide Area" <br /> Fund to accumulate all the design, right-of-way and construction costs for the <br /> correction of the earth slide problem on Laurel Drive. <br /> WHEREAS on February 5, 1986, the Everett City Council authorized a <br /> geotechnical study to investigate the earthslide problem along Laurel Drive. <br /> WHEREAS on May 28, 1986, the Everett City Council conducted a public meeting <br /> to air the conclusions formed from the geotechnical study. <br /> WHEREAS on June 4, 1986 the Everett City Council conducted a public meeting at <br /> the landslide site to obtain firthand knowledge of the slide area and the <br /> alternatives for the correction of the problem. <br /> WHEREAS on June 25 and July 9, 1986, the Everett City Council conducted a <br /> public hearing on the slide problem and recommended that a committee be formed <br /> to recommend corrective action. <br /> WHEREAS on October 1, 1986, the Everett City Council authorized the <br /> expenditure of $30,000 for the closure of Laurel Drive to vehicular traffic. <br /> WHEREAS on February 18, 1987, the Everett City Council authorized a $3,500 <br /> project of reduced scope, as recommended by the Public Works Department, to <br /> correct several drainage and monumentation problems in the area. <br /> WHEREAS, on December 2, 1987, the Everett City Council directed that a Plans <br /> and Systems Ordinance be presented to Council to budget $170,000 toward the <br /> soldier pile method of bank stabilization, contingent upon a satisfactory <br /> agreement being reached with several Laurel Drive residents to fund $60,000 of <br /> the improvement. <br /> NOW, THEREFORE BE IT ORDAINED BY THE EVERETT CITY COUNCIL THAT: <br /> Section 1: A special construction fund is hereby established as fund program <br /> entitled "Laurel Drive Slide Repair" to accumulate the funds <br /> required to accomplish the action authorized by this ordinance. <br /> Section 2: The scope of this action shall be to accomplish all tasks required <br /> to construct the soldier pile solution to the Laurel Drive south <br /> slide as described in the "LAUREL DRIVE LANDSLIDE INVESTIGATION" <br /> report dated, May 13, 1986. <br /> Section 3: The total estimated cost of the improvement herein authorized is <br /> $170,000 which shall include all costs related to the design, <br /> construction contract administration, right-of-way and easements. <br /> Section 4: The sum of $170,000 is hereby appropriated to Fund 313 Program 943 <br /> Laurel Drive Slide Area W.O. 1837 to accomplish the action required <br /> by this ordinance. It is planned that $60,000 of these funds will <br /> be reimbursed to the General Fund through private landowner <br /> agreements. <br /> Section 5: The Mayor is authorized to enter contribution agreements <br /> substantially in the form approved by City Council on December 2, <br /> 1987. The Mayor shall not commence any of the work authorized <br /> under this ordinance until fully-executed contribution agreements <br /> totalling $60,000 are received by the City. <br /> Section 6: Authorization is hereby granted for the Public Works Director/City <br /> Engineer, under the direction of the Mayor, to assume full and <br /> complete responsibility for conducting all tasks to accomplish the <br /> actions authorized in Section 2 of this ordinance. <br />
