4. notification of any significant plant expansions or retirements planned or in progress . The City shall have sole determination as to what constitutes a significant plant expansion or retirement. In addition, the Bond Insurer shall receive a copy of the disclosure document, if any, circulated in connection with the issuance of future Parity Bonds. H. No Free Service. The City will not furnish or supply or permit the furnishing or supplying of any commodity, service or facility furnished by or in connection with the opera- tion of the System, free of charge to any person, firm or corpora- tion, public or private, so long as any Parity Bonds are outstanding and unpaid. I . Additions and Improvements. The City will not expend any of the revenues derived by it from the operation of the System or the proceeds of any indebtedness payable from the Revenue of the System for any extensions, betterments or improve- ments to the System which are not legally required or economically sound, and which will not properly and advantageously contribute to the conduct of the business of the System in an efficient manner. J. Prior Agreement. The City shall comply with all terms and conditions of the Water Purchase Agreement, dated September 6, 1960, between the City and Alderwood Water District, as such agreement has been and may be amended from time to time. K. Collection of Delinquent Accounts. The City will, on or before April 1 of each calendar year, determine all accounts that are delinquent and will take all necessary action to enforce payment of such accounts including real property foreclosure actions pursuant to RCW Chapter 35 . 67, as amended, or its succes- sor statute, if any, against those property owners whose accounts are delinquent. -37- KR180 88/01/11
