w • • <br /> Everett Po/ice Department <br /> � Code Enforcement Unit <br /> 4/12/2017 CE17-0220 <br /> Adam C & Marjan S Russell <br /> 2119 E Grand Ave <br /> Everett, WA 98201 <br /> Violation Address: 2119 E Grand Avenue Everett, WA. 98201-3336 <br /> Dear Adam & Marjan Russell, <br /> An inspection of your premises/property located at 2119 E GRAND AVE, was made on <br /> April 4, 2017. The inspection revealed a portion of the property has been altered and <br /> gravel has been added. This area begins in the north front yard and continued down a <br /> slope in the north side yard. A white drainage pipe was observed extending from the <br /> bottom of this first bank to the east and toward the second steep bank. This residential <br /> property is within a wetland and steep slope critical area buffer and the alteration <br /> without required permits and approvals is a violation of Everett Municipal Code (EMC) <br /> 19.37.030. <br /> The unpermitted alterations of the critical area and/or critical area buffer are <br /> violations of Everett Municipal Code (EMC) 19.37.030 (A&B) which reads: <br /> EMC 99.37.030 Applicability. <br /> A. This chapter estab/ishes regulations for the protection of critical areas that are <br /> not otherwise regulated by the Shoreline Management Act and city of Everett <br /> Shoreline Master Program. The provisions of this chapter apply to all lands, all land <br /> uses and development activity, and a/l structures or facilities outside of shoreline <br /> jurisdiction rn the city, whether or not a permit or authorization is required, and shall <br /> app/y to every person, firm, partnership, corporation, group, government agency, or <br /> other entity thaf owns, leases or administers land within the city. No person, <br /> company, agency, or applicant shall alter a critical area or butfer except as <br /> consistent with the purposes and requirements of this chapter. Except for Sections <br /> 37.050.8 and 37.120.C, the provisions of this chapter shall a/so apply to <br /> development within shoreline jurisdiction in the marshland subarea. No development <br /> permit may be issued; no subdivision of land may be approved; no clearing, filling, or <br /> grading may occur; nor may any use be established, altered, or expanded on any lot <br /> until approvals required by this chapter have been granted by the city. <br /> 8. In addition to the requirements of this chapter, the applicant shall obtain all <br /> necessary state and federal and other local permifs.
