. . . � � <br /> �,;. <br /> Ev Err <br /> BUILDING PERMIT INDEMNIFICATION <br /> BUILDING PERMIT # B 1505-054 <br /> The Port of�Everett (Port) is receiving the building permit referred to above from the City <br /> of Everett (City) for the Port's bulkhead replacement project, generally located between 14`" and <br /> 16th Streets, adjacent to the Port's Central Marina. The Port is a public agency with long-term <br /> experience with bulkheads and port facilities. Accordingly, the Port takes, with respect to the <br /> City, complete responsibility for project design regarding earthquakes ar other seismic events. <br /> In the event of any earthquake or other seismic event, the Port shall indemnify, defend, and hold <br /> the City and its officers, employees and agents harmless from and against any liability, loss, <br /> damage, expense, actions or claims to the extent arising from or relating to the City's issuance of <br /> the building permit referred to above when such liability, loss, damage, expense, actions or <br /> claims result from or are caused by the design regarding earthquakes or other seismic events or <br /> the construction according to such design. Nothing in this Indemnification is intended to create a <br /> duty running to or special relationship with any third party.
