1 ORDINANCE NO. /3 9 —f7 <br /> 2 <br /> AN ORDINANCE prohibiting cruising and establishing penalty <br /> 3 therefor. <br /> 4 <br /> 5 WHEREAS, the Everett City Council finds that cruising of motor vehicles <br /> 6 at certain hours and in certain areas of the City causes traffic congestion, <br /> 7 obstruction of streets, sidewalks, or parking lots, impediment of access to <br /> 8 shopping centers or other buildings open to the public, or interference with <br /> 9 the use and enjoyment of property and/or the conduct of business in the <br /> 10 areas adjacent thereto; <br /> 11 NOW, THEREFORE THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1 : CRUISING. <br /> 13 A. No person shall drive or permit a motor vehicle under his care, <br /> 14 custody, or control to be driven past a traffic control point more than two <br /> 15 times in the same direction of travel within a two hour period in or around <br /> 16 a posted "No Cruising" area. <br /> 17 B. On the major streets or alleys of a "No Cruising" area there <br /> 18 shall be posted a sign which shall read substantially as follows: <br /> 19 <br /> NO CRUISING AREA <br /> 20 <br /> City Ordinance No. 1396-87 <br /> 21 <br /> Maximum Penalty - $1 ,000 <br /> 22 <br /> 23 C. A traffic control point as used in this section means any point <br /> 24 or points within the "No Cruising" area established by the Police Department <br /> 25 for the purpose of monitoring cruising. <br /> 26 D. No violation shall occur except upon the third passage in the <br /> 27 same direction of travel past the same traffic control point within the <br /> 28 aforementioned two hour period. <br /> 29 E. No area shall be designated or posted as a "No Cruising" area <br /> 30 except upon the passage of a resolution by the City Council specifically <br /> 31 mandating said designation and posting for a particular area. <br /> 32 <br /> 1 <br />
