1 ORDINANCE NO. it5s; /--t7 2 AN ORDINANCE amending the City of Everett's Adult Use Business 3 Zoning Ordinance, Ordinance No. 1303-86. 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : That Section l (D) (2) of Ordinance No. 1303-86 which reads 7 as follows: 8 Adult use businesses which are nonconforming uses in the zone in 9 which they are located and which are located within the City limits of Everett as of the effective date of this ordinance 10 shall be discontinued within five (5) years of the date this ordinance becomes effective or upon the expiration of the 11 leasehold period in existence as of the date this ordinance is passed, whichever occurs first. Adult use businesses which are 12 nonconforming as a result of annexation to the City of Everett shall be discontinued within two years of the date of 13 annexation. Adult use businesses which are nonconforming cannot be expanded, enlarged or intensified. Any building containing a 14 nonconforming adult use business may only be maintained with ordinary repair. It cannot be expanded nor enlarged. Any change 15 in a nonconforming adult use business shall be to a use which is legally permitted within the zone in which it is located. 16 17 be and the same is hereby amended to read as follows: 18 Adult use businesses which are nonconforming uses in the zone in 19 which they are located and which are located within the City limits of Everett as of the effective date of this ordinance 20 (November 7, 1986) shall be discontinued within five (5) years of the date this ordinance becomes effective or upon the expiration 21 of the leasehold period in existence as of the date this ordinance is passed (October 22, 1986) or upon the sale of the 22 nonconforming adult use business, whichever occurs first. Adult use businesses which are nonconforming as a result of annexation 23 to the City of Everett shall be discontinued within two years of the date of annexation. 24 Such nonconforming adult use businesses shall not be extended, 25 expanded, enlarged, or increased in intensity. Such prohibited activities (extend, expand, enlarge, increase in intensity) shall 26 include: 27 a. Extension of a nonconforming adult use business to any building or other structure or land area other than one 28 occupied by such use on the effective date of this ordinance. 29 b. Extension of any specific type of nonconforming adult use 30 business, as separately defined in Section 1 (B) of this ordinance, within a building or other structure to any 31 portion of the floor area that was not occupied by that same type of adult use business on the effective date of 32 this ordinance.
