1 ORDINANCE NO. it5s; /--t7 <br /> 2 <br /> AN ORDINANCE amending the City of Everett's Adult Use Business <br /> 3 Zoning Ordinance, Ordinance No. 1303-86. <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : That Section l (D) (2) of Ordinance No. 1303-86 which reads <br /> 7 as follows: <br /> 8 <br /> Adult use businesses which are nonconforming uses in the zone in <br /> 9 which they are located and which are located within the City <br /> limits of Everett as of the effective date of this ordinance <br /> 10 shall be discontinued within five (5) years of the date this <br /> ordinance becomes effective or upon the expiration of the <br /> 11 leasehold period in existence as of the date this ordinance is <br /> passed, whichever occurs first. Adult use businesses which are <br /> 12 nonconforming as a result of annexation to the City of Everett <br /> shall be discontinued within two years of the date of <br /> 13 annexation. Adult use businesses which are nonconforming cannot <br /> be expanded, enlarged or intensified. Any building containing a <br /> 14 nonconforming adult use business may only be maintained with <br /> ordinary repair. It cannot be expanded nor enlarged. Any change <br /> 15 in a nonconforming adult use business shall be to a use which is <br /> legally permitted within the zone in which it is located. <br /> 16 <br /> 17 be and the same is hereby amended to read as follows: <br /> 18 <br /> Adult use businesses which are nonconforming uses in the zone in <br /> 19 which they are located and which are located within the City <br /> limits of Everett as of the effective date of this ordinance <br /> 20 (November 7, 1986) shall be discontinued within five (5) years of <br /> the date this ordinance becomes effective or upon the expiration <br /> 21 of the leasehold period in existence as of the date this <br /> ordinance is passed (October 22, 1986) or upon the sale of the <br /> 22 nonconforming adult use business, whichever occurs first. Adult <br /> use businesses which are nonconforming as a result of annexation <br /> 23 to the City of Everett shall be discontinued within two years of <br /> the date of annexation. <br /> 24 <br /> Such nonconforming adult use businesses shall not be extended, <br /> 25 expanded, enlarged, or increased in intensity. Such prohibited <br /> activities (extend, expand, enlarge, increase in intensity) shall <br /> 26 include: <br /> 27 a. Extension of a nonconforming adult use business to any <br /> building or other structure or land area other than one <br /> 28 occupied by such use on the effective date of this <br /> ordinance. <br /> 29 <br /> b. Extension of any specific type of nonconforming adult use <br /> 30 business, as separately defined in Section 1 (B) of this <br /> ordinance, within a building or other structure to any <br /> 31 portion of the floor area that was not occupied by that <br /> same type of adult use business on the effective date of <br /> 32 this ordinance. <br />
