• 1 ORDINANCE NO. /si&(f 7 2 AN ORDINANCE establishing CEASE AND DESIST ORDERS as an 3 enforcement procedure for certain City of Everett ordinances and amending certain ordinances to accomplish 4 said procedure. 5 6 WHEREAS, the City Council finds that violations of City regulations 7 pertaining to rubbish and nuisances, use of City streets and sidewalks, 8 utilities, signs and billboards, land use regulations, and other 9 miscellaneous matters often do not involve imminent danger to others or 10 breach of the peace and may, accordingly, be enforced by a fine only; and 11 WHEREAS, the City Council further finds that certain violations, such 12 as zoning and other land use matters, require substantial time and expertise 13 to investigate; and 14 WHEREAS, the City Council further finds that administrative actions 15 regarding violations of the above-described regulations should be subject to 16 review by a Hearing Examiner, as an impartial forum, prior to court 17 citations; and 18 WHEREAS, the Council further finds that the objectives of careful 19 investigation and full opportunity for impartial review of administrative 20 action may be accomplished by a procedure under which administrative orders 21 are subject to review by a Hearing Examiner and City Council is not involved 22 in the review process ; 23 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 24 Section 1 : The Mayor or City staff members authorized by the Mayor to 25 inspect or investigate compliance with City codes and ordinances are hereby 26 authorized to issue and serve a NOTICE OF VIOLATION upon reasonable cause to 27 believe that a violation of the ordinances set forth in Section 2 hereof has 28 occurred.
