• <br /> 1 No. 1348-87, as it currently reads or is hereafter amended: Chapter 20.04 of <br /> 2 Everett Municipal Code) . In the event there is a violation or failure to <br /> 3 comply, the procedure authorized herein shall be the enforcement procedure <br /> 4 utilized unless the City Administration, upon the concurrence of the City <br /> 5 Attorney, files for injunctive or other civil relief in Superior Court. <br /> 6 Section 3: All NOTICE OF VIOLATIONS issued by staff shall be submitted <br /> 7 to the Violations Hearing Examiner, as established under Section 4 hereof, <br /> 8 who shall inquire as to the validity of the violation. Said notice my be <br /> 9 amended by City staff in the course of contested proceedings. If the <br /> 10 Violations Hearing Examiner finds that the violation exists substantially as <br /> 11 stated by City staff, said Violations Hearing Examiner shall issue a CEASE <br /> 12 AND DESIST ORDER in a form consistent with his or her findings. <br /> 13 Section 4: <br /> 14 A. There is hereby created the office of Violations Hearing Examiner. <br /> 15 B. Violations Hearing Examiner(s) shall be part-time and remunerated <br /> 16 by personal service contract. <br /> 17 C. The Violations Hearing Examiner(s) shall be appointed by the <br /> 18 Mayor. <br /> 19 D. Violations Hearing Examiner(s) shall be licensed to practice law <br /> 20 in the state. <br /> 21 E. The Violations Hearing Examiner will be responsible for presiding <br /> 22 over all hearings on Notices of Violations as well as other additional <br /> 23 administrative matters over which he/she may be requested to preside. <br /> 24 F. The Violations Hearing Examiner shall have the power to: <br /> 25 <br /> 26 1 . Administer oaths and affirmations, examine witnesses <br /> and receive evidence; <br /> 27 2. Issue subpoenas upon the request of any party. The <br /> 28 City Treasurer, his designated agent, the City <br /> Attorney and any officer authorized to enforce this <br /> 29 ordinance are also authorized to issue subpoenas. <br /> When so required, the applicant for the subpoena <br /> 30 shall show to the satisfaction of said individual the <br /> general relevance and reasonable scope of the <br /> 31 evidence sought; <br /> 32 <br /> 4 <br />
