Section 4: The total estimated cost of the West Marine View Drive (18th to Pacific et al) improvements is $13,000,000 which includes all costs related for Phase I, II, and III as outlined in Section 3. II Section 5: The sum of $1,374,366 is hereby appropriated to fund No. 392 as follows: a. Appropriation (1) Phase I - Preliminary Design (Program 927) $1,374,366 (2) Phase II - Right-of-way (Program 928) To be determined later*. (3) Phase III - Construction (Program 929) To be determined later*. b. Source of Funds (1) Phase I - Military Traffic Management Command $1,374,366 (2) Phase II - Military Traffic Management To be determined Command later* (3) Phase III - Military Traffic Management To be determined Command later*. *NOTE: The appropriation required for Phase II and Phase III shall be made at a later date by amendment to this ordinance, as determined by the consultant's design report in Phase I. The source of funds will be 100% for all phases. Section 6: Severability. If any y provision of this ordinance be declared unconstitutional or invalid by any court of competent jurisdiction, it shall be conclusively presumed that this ordinance would have been enacted without the provision so held unconstitutional or invalid and the remainder of this ordinance shall not be affected as a result of said part being held unconstitutional or invalid. II Section 7: The City Treasurer of the City of Everett is hereby authorized to obtain interim financing which may be in any form permitted by law. Interim financing liabilities shall be paid by the Treasurer as soon as permanent financing monies, from sources as described elsewhere in this ordinance, are received. -2-
