1 ORDINANCE NO. /3ft-f7 2 AN ORDINANCE amending the City' s Outdoor Burning Ordinance, 3 Ordinance No. 820-81 (Chp. 8.28 EMC) . 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1 : Section 3 of Ordinance No. 820-81 (EMC 8.28.020) which 7 reads as follows: 8 DEFINITION OF OUTDOOR FIRE. 9 "Outdoor fire" means the combustion of material in the open. 10 11 be and the same is hereby amended to read as follows: 12 DEFINITIONS. For purposes of this ordinance, the following 13 definitions shall apply: 14 A. "Clearing Land" (land clearing) - any filling, grubbing (removing of stumps and/or vegetation), excavating or 15 grading of land. 16 B "Development" - the construction of a structure(s) or the improvement of property for which a State Environmental 17 Policy Act (SEPA) review is required by the City of Everett. . 18 C. "Outdoor fire" - the combustion of material in the open. 19 20 Section 2: Section 5 of Ordinance No. 820-81 (EMC 8.28.040) which 21 reads as follows: 22 LAND CLEARING BURNING. 23 Outdoor burning for the purpose of clearing land shall be 24 permitted only if all of the following conditions are met: 25 A. Prior written approval has been issued by the Control Officer of the Puget Sound Air Pollution Control Agency, and 26 B. All other rules, regulations and requirements set forth in 27 Regulation 1 of the Puget Sound Air Pollution Control Agency are met, and 28 C. The fire is not within 100 feet of any structure other than 29 that located on the property on which the burning is conducted, and 30 D. The average population density as defined by the United 31 States Bureau of the Census within 0.6 miles of the proposed burning site is 2,500 persons per square mile or 32 less, and
