1 ORDINANCE NO. /3ft-f7 <br /> 2 <br /> AN ORDINANCE amending the City' s Outdoor Burning Ordinance, <br /> 3 Ordinance No. 820-81 (Chp. 8.28 EMC) . <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1 : Section 3 of Ordinance No. 820-81 (EMC 8.28.020) which <br /> 7 reads as follows: <br /> 8 <br /> DEFINITION OF OUTDOOR FIRE. <br /> 9 <br /> "Outdoor fire" means the combustion of material in the open. <br /> 10 <br /> 11 be and the same is hereby amended to read as follows: <br /> 12 <br /> DEFINITIONS. For purposes of this ordinance, the following <br /> 13 definitions shall apply: <br /> 14 A. "Clearing Land" (land clearing) - any filling, grubbing <br /> (removing of stumps and/or vegetation), excavating or <br /> 15 grading of land. <br /> 16 B "Development" - the construction of a structure(s) or the <br /> improvement of property for which a State Environmental <br /> 17 Policy Act (SEPA) review is required by the City of <br /> Everett. . <br /> 18 <br /> C. "Outdoor fire" - the combustion of material in the open. <br /> 19 <br /> 20 Section 2: Section 5 of Ordinance No. 820-81 (EMC 8.28.040) which <br /> 21 reads as follows: <br /> 22 <br /> LAND CLEARING BURNING. <br /> 23 <br /> Outdoor burning for the purpose of clearing land shall be <br /> 24 permitted only if all of the following conditions are met: <br /> 25 A. Prior written approval has been issued by the Control <br /> Officer of the Puget Sound Air Pollution Control Agency, and <br /> 26 <br /> B. All other rules, regulations and requirements set forth in <br /> 27 Regulation 1 of the Puget Sound Air Pollution Control <br /> Agency are met, and <br /> 28 <br /> C. The fire is not within 100 feet of any structure other than <br /> 29 that located on the property on which the burning is <br /> conducted, and <br /> 30 <br /> D. The average population density as defined by the United <br /> 31 States Bureau of the Census within 0.6 miles of the <br /> proposed burning site is 2,500 persons per square mile or <br /> 32 less, and <br />
