1 G. An adult is available to supervise the fire at all times; 2 H. The fire shall be maintained within two hundred (200) feet of an adequate source of water connected to a hose with 3 nozzle under pressure sufficient to project a stream of water that will reach every area within ten (10) feet of 4 such fire. If, in the case of land clearing, the area to be cleared is so large that adequate water is not within 5 two hundred (200) feet, burning shall be allowed provided a bulldozer operator and a bulldozer are kept within two 6 hundred (200) feet of the fire; 7 I. Only materials on the site where permission has been approved by the Controller of the Puget Sound Air Pollution 8 Control Agency and City of Everett may be burned. No materials may be hauled to a site where land clearing 9 burning has been approved from a site where such approval has not been granted; 10 J. The Everett Fire Chief or his designee has determined that 11 the person who proposes to burn is in compliance with all applicable City of Everett rules, regulations, and 12 ordinances; and 13 K. The applicant has paid a fee in the amount of Fifty Dollars ($50) . 14 15 Section 3: Ordinance No. 820-81 is hereby amended by the addition of 16 the following section: 17 VARIANCE 18 The Fire Chief or his designee may authorize variances from the 19 provisions of this Ordinance to allow outdoor fires. No such variance shall be authorized unless the Fire Chief or designee 20 finds that all of the following exist: 21 A. Applicant complies with all of the requirements of the Puget Sound Air Pollution Control Agency; 22 B. There are exceptional circumstances or conditions which 23 apply to the applicant's request; 24 C. The authorization of the variance will not be injurious to the property in the vicinity of where the applicant's 25 property is located; and 26 D. Applicant has paid a fee in the amount of Fifty Dollars ($50) . If the applicant is unsuccessful in obtaining the 27 variance, the fee will be refunded. 28 In authorizing a variance, the Fire Chief or his designee may attach thereto such conditions as are deemed necessary to ensure 29 that the fire will be properly regulated. A variance may be withdrawn at any time it is determined that the conditions of the 30 variance are not being complied with or that the facts and/or circumstances upon which the variance was based change. The Fire 31 Chief or his designee is authorized to promulgate rules and regulations to assist in the administration of the variance 32 provision of this ordinance. 3
