1 G. An adult is available to supervise the fire at all times; <br /> 2 H. The fire shall be maintained within two hundred (200) feet <br /> of an adequate source of water connected to a hose with <br /> 3 nozzle under pressure sufficient to project a stream of <br /> water that will reach every area within ten (10) feet of <br /> 4 such fire. If, in the case of land clearing, the area to <br /> be cleared is so large that adequate water is not within <br /> 5 two hundred (200) feet, burning shall be allowed provided a <br /> bulldozer operator and a bulldozer are kept within two <br /> 6 hundred (200) feet of the fire; <br /> 7 I. Only materials on the site where permission has been <br /> approved by the Controller of the Puget Sound Air Pollution <br /> 8 Control Agency and City of Everett may be burned. No <br /> materials may be hauled to a site where land clearing <br /> 9 burning has been approved from a site where such approval <br /> has not been granted; <br /> 10 <br /> J. The Everett Fire Chief or his designee has determined that <br /> 11 the person who proposes to burn is in compliance with all <br /> applicable City of Everett rules, regulations, and <br /> 12 ordinances; and <br /> 13 K. The applicant has paid a fee in the amount of Fifty Dollars <br /> ($50) . <br /> 14 <br /> 15 Section 3: Ordinance No. 820-81 is hereby amended by the addition of <br /> 16 the following section: <br /> 17 <br /> VARIANCE <br /> 18 <br /> The Fire Chief or his designee may authorize variances from the <br /> 19 provisions of this Ordinance to allow outdoor fires. No such <br /> variance shall be authorized unless the Fire Chief or designee <br /> 20 finds that all of the following exist: <br /> 21 A. Applicant complies with all of the requirements of the <br /> Puget Sound Air Pollution Control Agency; <br /> 22 <br /> B. There are exceptional circumstances or conditions which <br /> 23 apply to the applicant's request; <br /> 24 C. The authorization of the variance will not be injurious to <br /> the property in the vicinity of where the applicant's <br /> 25 property is located; and <br /> 26 D. Applicant has paid a fee in the amount of Fifty Dollars <br /> ($50) . If the applicant is unsuccessful in obtaining the <br /> 27 variance, the fee will be refunded. <br /> 28 In authorizing a variance, the Fire Chief or his designee may <br /> attach thereto such conditions as are deemed necessary to ensure <br /> 29 that the fire will be properly regulated. A variance may be <br /> withdrawn at any time it is determined that the conditions of the <br /> 30 variance are not being complied with or that the facts and/or <br /> circumstances upon which the variance was based change. The Fire <br /> 31 Chief or his designee is authorized to promulgate rules and <br /> regulations to assist in the administration of the variance <br /> 32 provision of this ordinance. <br /> 3 <br />
