ORDINANCE No. /t '2 - <br /> An Ordinance amending Ordinance No. 3267 which vacated <br /> a portion of 41st Street at the Northeast corner <br /> of the intersection with Colby Avenue. <br /> WHEREAS, the City of Everett vacated a portion of 41st Street by <br /> Ordinance No. 3267, and <br /> WHEREAS, the City retained unto itself an easement for sewer <br /> purposes, and <br /> WHEREAS, the sewer lines for which said easement was retained have <br /> been abandoned and are of no future use to the City, and <br /> WHEREAS, the owner of the property to which title of said vacated <br /> right of way was vested by law wishes the City to relinquish the easement <br /> rights which the City no longer requires for sewer purposes, and <br /> � I <br /> WHEREAS, the City wishes to exchange said easement rights for real <br /> property needed for right of way purposes and owned by said owner. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> That Section 1 of Ordinance 3267 which reads: <br /> �I I <br /> Section 1: That the property in the City of Everett, County of <br /> Snohomish, State of Washington, described as follows, to-wit: <br /> I BEGINNING at the Southeast corner of Block 10, South Park <br /> Addition to Everett, Washington; THENCE, westerly along the <br /> south line of said Block 10 for 90.62 feet to the T.P.O.B. ; <br /> THENCE, continued westerly along the same straight line to <br /> apoint of intersection with the north line of Lot A, Block <br /> 17, South Park Addition to Everett; THENCE, northwesterly <br /> along the north line of said Lot A to the most northerly <br /> corner of said Lot A, Block 17, and the E.P.L. of Colby <br /> Avenue; THENCE, northerly along the E.P.L. of Colby Avenue <br /> to the south line of Section 30, Township 29 North, Range 5 <br /> East, W.M. ; THENCE easterly along said south line Section <br /> 30 for 0.80 feet to the north line of 41st Street as <br /> platted in Block 10, South Park Addition to Everett; THENCE <br /> southerly along north of 41st Street as platted in Block <br /> jl 10, South Park Addition to Everett to the true point of <br /> beginning; less the alley in Block 10, South Park Addition <br /> to Everett. <br /> be, and the same is hereby vacated, and the title to the land in said portion <br /> of street, above described, is hereby declared to vest in the abutting <br /> property owners as provided by law, subject to an easement to the City of <br /> Everett for the maintenance and operation of sewer and sewer lines under, <br /> over, and across the property hereinabove described, togetherwith the right of <br /> egress and ingress for the purpose of maintenance, repair, and replacement of <br /> said sewer lines; and provided further, that no buildings or structures shall <br /> be erected over, across or upon said sewer lines now existing under, over, and <br /> across said property or sewer lines hereinafter replacing said sewer lines <br /> without first having secured a permit from the City Engineer to erect such <br /> �I buildings or structures over and across said sewer line. <br /> ii <br />
