the subject property that conformed to the zoning code in effect <br /> when the improvement was constructed. <br /> (3) The variance will only grant the subject property the same general <br /> rights enjoyed by other property in the same area and zone as the <br /> subject property. <br /> (4) The variance is the minimum necessary to allow the subject property <br /> the general rights described in Criteria 3 above. <br /> (5) The granting of the variance is not inconsistent with the goals and <br /> policies of the Everett general plan. <br /> (6) The need for the requested variance is not the result of a self- <br /> created hardship. <br /> CONCLUSIONS BASED ON FINDINGS <br /> 1. The Applicant requested approval of a variance from the Development Standards <br /> Table 6.1 of EMC Chapter 19.6. Specifically, the Applicant requests relief from <br /> the minimum setback requirements of five feet from the interior side yard lot line <br /> for R-1 zoned property at 5621 Rockefeller Avenue, Everett, Washington. <br /> (finding 1) <br /> 2. The variance will not be detrimental to the property in the area of the subject <br /> property or to the City as a whole. The variance allows for reconstruction of a <br /> use that has been in existence for a significant period of time and prior to 1978. <br /> (findings 7 and 8) <br /> 3. Exceptional circumstances regarding the location of a pre-existing improvement <br /> on the subject property that may at one time have conformed to the Zoning Code <br /> in effect, support that the variance is necessary because of special or <br /> extraordinary circumstances. (finding 10) <br /> 4. The variance grants the subject property the same basic rights of development <br /> as enjoyed by other property owners in the general area and zone. It allows for a <br /> garage and shed to be built in a manner similar to many properties in this section <br /> of the City of Everett. (finding 11) <br /> 5. The variance is the minimum necessary to allow the subject property to be <br /> developed. (findings 12 and 15) <br /> 6. The grant of the variance is consistent with the goals and policies of the City of <br /> Everett General Plan. (finding 13) <br /> 7. The grant of the variance is not the result of a self-created hardship. (finding 14) <br /> 8. In the City of Everett and the State of Washington, each variance is reviewed on <br /> its own merits.
