<br /> 4 Owncrship and Maintenance Itcsponsibility•
<br /> a. Grantor's System is and will bc lhe property of the Gianlor. Except as
<br /> provided in SecLion 7 of this Agreement,the Grantor shall,at its sole cost,operate and maintain
<br /> Grantor's System in accordance with all applicable laws and permits.
<br /> b. 'I'he Stormwater Facilities are and will be property of the City. The City
<br /> shall,at its sole cost.operate and maintain the Stormwater Facilities in accordance with all
<br /> applicable laws and permits, including implementation of activities required under Special
<br /> Condition S�of the Phase II Western Washington Municipal Stormwater Permit or described in
<br /> the City`s Stormwater Management Program as they relate to the Stormwater Facilities or the
<br /> Service Area.
<br /> e. "I'he Grantor shall have the right to inspect the StormwaCer l�acilities,but
<br /> shall have no obligation to operate or maintain thc Stormwatcr Facilities.
<br /> 5 Limitation on Scrvice Area. 'I'he City shall not directly or indirectly cxpand the
<br /> area tributary to and dischargine to the Grantor's Systcm beyond the Service Arca.
<br /> 6 Term. Unlcss carlier terminaled by mutual agreement of lhe parties�s
<br /> �,�� : '��;T,this ngreement shall remain in lull li�rce and effect until such time as the City
<br /> extends storm sewer service to the Service Arca. Discharge ol�stormwatcr through the
<br /> Stormwater Facilities to the Grantor's System is subjecL to local,statc,an�federal water quality
