• <br /> 1 ORDINANCE NO. -Y7/.3,6-11 <br /> 2 <br /> AN ORDINANCE defining the offense of aggressive begging and <br /> 3 prescribing a penalty therefor. <br /> 4 <br /> 5 The City Council of the City of Everett makes the following findings: <br /> 6 1. That numerous complaints have been received concerning the <br /> 7 unreasonable conduct of certain persons begging for money in public places. <br /> 8 These complaints relate to begging which is done in a menacing or <br /> 9 threatening manner and/or in a manner where the beggar steps in front of the <br /> 10 victim's direction of travel interfering with the victim's right of movement. <br /> 11 2. That this ordinance is intended to control the manner of begging <br /> 12 in which victims are accosted in public places and not intended to prohibit <br /> 13 persons who stand or sit at the wayside out of others' direction of travel <br /> 14 and solicit funds for themselves or for charitable causes; <br /> 15 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 16 Section 1: AGGRESSIVE BEGGING. <br /> 17 A. It is unlawful for a person to aggressively beg as defined by <br /> 18 this section. A person is guilty of aggressive begging if he or she: <br /> 19 <br /> 1. Begs in a manner that hinders or obstructs the free passage <br /> 20 of any person in a public place, or <br /> 21 2 . By physical action while in the act of begging, he or she <br /> intentionally causes or attempts to cause another person <br /> 22 reasonably to fear imminent bodily harm or the commission <br /> of a criminal act upon their person, or upon property in <br /> 23 their immediate possession. <br /> 24 <br /> B. Definitions: As used in this section: <br /> 25 <br /> 26 1. "To beg" means to stop or accost others, or direct persons <br /> or animals to stop or accost others, and to ask for money <br /> 27 whether by words, bodily gestures, signs or other devices. <br /> 28 2. "Public place" is an area generally visible to public view <br /> and includes streets, sidewalks, bridges, alleys, plazas, <br /> 29 parks, driveways, parking lots, and buildings open to the <br /> general public, including those that serve food or drink or <br /> 30 provide entertainment, and the doorways and entrances to <br /> buildings or dwellings and the grounds enclosing them. <br /> 31 <br /> 32 <br />
