• <br /> XI. <br /> FORMS <br /> Section XIA: Adoption by Reference. <br /> The City of Everett adopts the following forms and sections of Chapter <br /> 197-11 WAC by reference, subject to the addition provisions contained in <br /> this part: <br /> 197-11-960 Environmental checklist <br /> 197-11-965 Adoption notice <br /> 197-11-970 Determination of nonsignificance (DNS) <br /> 197-11-980 Determination of significance and scoping <br /> notice (DS) <br /> 197-11-985 Notice of assumption of lead agency status <br /> 197-11-990 Notice of action <br /> The City shall use the forms substantially as set forth in the SEPA rules. <br /> However, the Responsible Official may modify the forms if he determines that <br /> a modified format would improve clear presentation of the proposed action, <br /> the environmental impacts of the proposed action, the environmental <br /> determination being made by the City, and/or the opportunity for commenting <br /> on the proposed action or environmental determination. <br /> XII. <br /> THIRD PARTY LIABILITY <br /> This ordinance provides for and promotes the health, safety, and welfare of <br /> the general public, and does not create or designate any particular class or <br /> group of persons who will or should be especially protected or benefitted by <br /> the terms of this ordinance. <br /> Nothing contained in this ordinance is intended to be nor shall be construed <br /> to create or form the basis for any liability on the part of the City, its <br /> officers, employees or agents, for any injury or damage resulting from the <br /> failure of any applicant to comply with the provisions of this ordinance, or <br /> by reason or in consequence of any inspection, notice, order, certificate, <br /> permission or approval authorized or issued or completed in connection with <br /> the implementation or enforcement pursuant to this ordinance or by reason of <br /> any action or inaction on the part of the City related in any manner to the <br /> enforcement of this ordinance by its officers, employees or agents. <br /> -27- <br />
