• <br /> HENRY LIEBMAN PROPERTY REZONE <br /> CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO. f 3 ‘71" tY7 <br /> THIS GREEMENT is made and entered this day <br /> of l , <br /> 1987, by Henry Liebman, hereinafter referred to as "Owner", and the City of <br /> Everett, a municipal corporation under the laws of the. State of Washington, <br /> hereinafter referred to as "the City"; <br /> WITNESSETH: <br /> WHEREAS, HENRY LIEBMAN is the owner of a tract of real property <br /> approximately 1.38 acres in size located east of 7th Avenue SE, north of <br /> Everett Mall Way in Everett, Snohomish County, Washington, the legal <br /> description of which is attached hereto as Exhibit A and incorporated herein <br /> by this reference; and <br /> WHEREAS, such property is located adjacent to existing commercial <br /> zoning and development which fronts on Everett Mall Way and will provide for <br /> a logical extension and transition between more intensive retail commercial <br /> uses on Everett Mall Way and the residentially zoned areas north of the <br /> subject property; and <br /> WHEREAS, the public health, safety and welfare would be best served <br /> by anticipating the impacts of development of the subject property and <br /> imposing certain mutually agreed upon standards, conditions and requirements <br /> which shall be documented herein and hereafter considered to be an integral <br /> part of the zoning restrictions applicable to the property; and <br /> WHEREAS, the Owner has agreed to develop a portion of the <br /> aforementioned property which property is described in Exhibit B, which is <br /> attached hereto and incorporated herein by reference, in consideration of <br /> the City designating the property described in Exhibit B and hereinafter <br /> referred to as "subject property," "commercial" on the General Plan Land Use <br /> Map and the Owner further agrees as part of said consideration that should <br /> the City zone the subject property C-1 , to lay out, develop and maintain the <br /> property as hereinafter set forth: <br /> NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. PERMITTED USES <br /> A. The property described in Exhibit B shall be zoned C-1, General <br /> Commercial. <br /> B. The use of the subject property shall be limited to: <br /> i. Professional offices, office buildings, general <br /> professional services; <br /> ii. Real estate offices; <br /> iii. Banks, savings and loan institutions, finance and <br /> insurance companies, credit unions; <br /> iv. Clinics, excluding veterinary clinics; <br /> v. Business offices with accessory warehouse storage. <br />
