Section 4: That the owners of the property abutting upon the street herein described shall, as additional consideration, grant an easement for Municipal Purposes, to the City of Everett, on a standard City of Everett Easement Form, under, over, and across the following described property: The North 20 feet of the West half of vacated 18th Avenue West lying between the South 720 feet of Tract 34 and 35, Beverly Berry Tracts Division No. 2, according to the plat thereof, recorded in Volume 10 of Plats, Page 20, records of Snohomish County, Washington; and The North 20 feet of the South 720 feet of said Tract 34; and The West 20 feet of the North 200 feet of the South 720 of said Tract 34; and The West 10 feet of the South 520 feet of the South 720 feet of said Tract 34, and said owners shall construct a 12" ductile iron waterline to City of Everett Design and Construction Standards and Specifications, to connect to, and "Loop" the existing water facilities abutting the above described easement, and to construct a 5 foot wide compacted gravel jogging path along the entire above described easement. Said owners shall have the same 90 days allowed in Section 3 above to complete the constuction requirements of this section and to grant the easement to the City of Everett required herein. Unless otherwise amended by City Council this ordinance shall be null and void if all of the requirements set forth in this Section are not complied with within the ninety day period set forth in Section 3 herein. Section 5: That all monies received by the City of Everett from the sale of the right-of-way vacation described in Section 1 herein shall be deposited in the "Real Property Acquisition Fund."(FUND 145) Section 6: Upon the payment of the required compensation and fulfillment of each and every condition recited herein, this ordinance shall be recorded with the Snohomish County Auditor.
