• <br /> j. Planned residential developments except for proposed <br /> developments exceeding 50 residential units in size; <br /> k. Special property use permits; <br /> 1. Conditional use permits; <br /> m. In situations where a planned residential development is <br /> combined with a preliminary subdivision procedure, the <br /> Hearing Examiner shall have jurisdiction over the entire <br /> procedure if the preliminary subdivision is 50 lots or <br /> less, or if the planned residential development is 50 <br /> units or less. <br /> 2. Recommendation. The decision of the Examiner on the following <br /> matter shall constitute a recommendation to the City Council <br /> which shall have the final authority to act on such <br /> applications: <br /> a. Rezones three (3) acres or less in size; <br /> b. Rezones for which there is a concurrent application for a <br /> development action as is set forth in Section 12(A)(1) <br /> regardless of the size of the rezone. In this case, the <br /> Examiner's decision shall constitute a recommendation as <br /> to the rezone and a decision as to the concurrent <br /> application for the development action. <br /> The Planning Commission shall retain jurisdiction over all <br /> other rezones not listed above including all rezones <br /> (amendments) set forth in E.M.C. 19.68.010. <br /> 3. Jurisdiction Retained by Planning Commission. Under the <br /> provisions of City Ordinance No. 3-68 and R.C.W. 35.63, the <br /> Planning Commission shall retain jurisdiction for all <br /> applications for development not assigned to the Hearing <br /> Examiner by this Ordinance. <br /> B. Recommendation or Decision, Conditions. <br /> 1. The Examiner's recommendation or decision may be to grant or <br /> deny the applications, or the Examiner may recommend or require <br /> of the applicant such conditions, modifications and <br /> restrictions as the Examiner finds necessary to make the <br /> application compatible with its environment and carry out the <br /> objectives and goals of the comprehensive plan, shoreline <br /> management master, housing assistance plan, other applicable <br /> plans and programs adopted by the City Council, the zoning <br /> ordinance, the subdivision ordinance and other codes and <br /> ordinances of the City of Everett. Conditions, modifications <br /> and restrictions which may be imposed are, but are not limited <br /> to: <br /> a. Exact location and nature of development, including <br /> additional building and parking area setbacks, screenings <br /> in the form of landscaped berms, landscaping, or fencing; <br /> b. Measures to mitigate the adverse environmental impacts of <br /> the development; <br /> c. Hours of use or operation or type and intensity of <br /> activities; <br /> -2- <br />
