• <br /> h. Compliance with conditions imposed pursuant to any land <br /> use permit or decision which has been issued by the <br /> Examiner; <br /> i. Shoreline management substantial development, conditional <br /> use or variance permit for projects from one to <br /> twenty-five acres in size and shoreline management <br /> substantial development permits for the following utility <br /> improvements: water supply distribution and storage <br /> facilities, sanitary sewage (and storm drainage when in a <br /> combined system) transmission and treatment facilities <br /> and storm water drainage systems. All other utility <br /> facilities shall be under the jurisdiction of the Everett <br /> Planning Commission; <br /> j. Special property use permits; <br /> k. Conditional use permits; <br /> 1. Where a concurrent application is submitted for a <br /> discretionary permit(s) and for a preliminary subdivision <br /> procedure, the Examiner shall have jurisdiction over the <br /> entire procedure. <br /> 2. Recommendations. The decision of the Examiner on the following <br /> matter shall constitute a recommendation to the City Council <br /> which shall have the final authority to act on such <br /> applications: <br /> a. Rezones three (3) acres or less in size; <br /> b. Rezones for which there is a concurrent application for a <br /> development action as is set forth in Section 12(A) (1) <br /> regardless of the size of the rezone. In this case, the <br /> Examiner's decision shall constitute a recommendation as <br /> to the rezone and a decision as to the concurrent <br /> II application for the development action; <br /> c. Where a rezone is combined with a preliminary subdivision <br /> procedure, the Hearing Examiner shall have jurisdiction <br /> over the entire procedure. The Examiner's decision shall <br /> constitute a recommendation as to the rezone and a <br /> decision as to the preliminary subdivision; <br /> * d. Where a Comprehensive Plan amendment is combined with a <br /> rezone, the Planning Commission shall have jurisdiction <br /> over the entire procedure. The Planning Commission shall <br /> retain jurisdiction over all other rezones not listed in <br /> this section including all amendments to Title 19 as set <br /> forth in E.M.C. 19.68.0101 <br /> e. Planned residential developments except for proposed <br /> developments exceeding 50 residential units in size. <br /> 3• Jurisdiction Retained by Planning Commission. Under the <br /> provisions of City Ordinance No. 3-68 and R.C.W. 35.63, the <br /> Planning Commission shall retain jurisdiction for all <br /> applications for development not assigned to the Hearing <br /> Examiner by this Ordinance. <br /> B.
