• • ORDINANCE NO. 4.545....F6, AN ORDINANCE providing for the vacation of a portion of CAMPUS PARKWAY. WHEREAS, the City Council of the City of Everett, did by Resolution No. c 7 90 , duly adopt and fix the 26th day of November, 1986, at 8:30 a.m. , as the date for public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the street which is vacated; and WHEREAS, the City Council finds that it would not vacate the street could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said street resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: ALL THAT PORTION OF CAMPUS PARKWAY DESCRIBED AS FOLLOWS: THAT PORTION OF THE SOUTHWEST QUARTER OF SECTION 7, TOWNSHIP 28 NORTH, RANGE 5 EAST, W.M. ; BEGINNING AT THE NORTHEAST CORNER OF THAT CERTAIN TRACT OF LAND CONVEYED BY ELLA C. ROSS, ET AL TO EVERETT SCHOOL DISTRICT No. 2 BY DEED RECORDED UNDER A.F. # 1322612, RECORDS OF SNOHOMISH COUNTY, WASHINGTON, WHICH POINT IS ON THE EAST LINE OF SAID SUBDIVISION, AND BEARS SOUTH 01° 42' 24" WEST A DISTANCE OF 849.93 FEET FROM THE NORTHEAST CORNER OF SAID SUBDIVISION; THENCE, NORTH 880 17' 36" WEST ALONG THE NORTH LINE OF SAID TRACT CONVEYED TO EVERETT SCHOOL DISTRICT No. 2, A DISTANCE OF 161.00 FEET TO A POINT ON A CURVE, AT WHICH POINT THE TANGENT TO SAID CURVE BEARS SOUTH 540 44' 08" EAST; THENCE, IN A SOUTHEASTERLY DIRECTION ALONG SAID CURVE TO THE RIGHT, HAVING A RADIUS OF 360.00 FEET; AN ARC DISTANCE OF 354.64 FEET TO A POINT ON THE EAST LINE OF SAID SUBDIVISION AT WHICH POINT THE TANGENT TO SAID CURVE BEARS SOUTH 01° 42' 24" WEST; THENCE, NORTH 010 42' 24" EAST ALONG THE EAST LINE OF SAID SUBDIVISION A DISTANCE OF 300.00 FEET TO THE POINT OF BEGINNING. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance.
