1 Section 13: CONFLICT/REPEAL. <br /> 2 All other ordinances and parts of other ordinances inconsistent or <br /> 3 conflicting with any part of this ordinance are hereby repealed to the <br /> 4 extent of such inconsistency or conflict. Specifically Ordinance No. <br /> 5 1169-85 is repealed. <br /> 6 Section 14: NON-LIABILITY. <br /> 7 It is expressly the purpose of this ordinance to comply with the <br /> 8 September 13, 1985 order of the Washington State Department of Ecology <br /> 9 requiring the City of Everett to establish an industrial pretreatment <br /> 10 program and to provide for and promote the health, safety and welfare of the <br /> 11 general public. It is not the intent of this ordinance to create or <br /> 12 otherwise establish or designate any particular class or group of persons <br /> 13 who will or should be especially protected or benefitted by the terms or <br /> 14 requirements of this ordinance. <br /> 15 It is the specific intent of this ordinance to place the obligation of <br /> 16 complying with these regulations upon the applicant or Discharger and no <br /> 17 provision nor any term used in this ordinance is intended to impose any duty <br /> 18 whatsoever upon the City or any of its officers, employees or agents, except <br /> 19 as provided under the Act or other related statutes of the United States or <br /> 20 the State of Washington. <br /> 21 Nothing contained in this ordinance is intended to be nor shall be <br /> 22 construed to create or form the basis for any tort liability on the part of <br /> 23 the City or its officers, employees or agents, for any injury or damage <br /> 24 resulting from the failure of an applicant or Discharger to comply with the <br /> 25 provisions of this ordinance, or by reason or in consequence of any <br /> 26 inspection, notice, order, certificate, permission or approval authorized or <br /> 27 issued or done in connection with the implementation or enforcement of this <br /> 28 ordinance, or inaction on the part of the City related in any manner to the <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br /> 23 <br />
