CITY OF EVERETT, WASHINGTON <br /> ORDINANCE NO. /1,504, -,‘" <br /> AN ORDINANCE to delete Section 4 of Ordinance No. 533-78 <br /> which provided for the vacation of a portion of McDougall <br /> Avenue lying east of Broadway and north of 61st Street. <br /> WHEREAS, the City Council of the City of Everett did by Ordinance Nb. <br /> 533-78 vacate the following described right of way: <br /> All that portion of McDougall Avenue lying west of Block 9 <br /> and easterly of Block 8, Replat of Pinehurst Division "A", <br /> according to the Plat thereof, recorded in Volume 9 of <br /> Plats, page 37, records of Snohomish County, Washington; <br /> and <br /> WHEREAS, the City of Everett retained an easement to construct, <br /> operate, maintain, repair and replace all public utilities under, over and <br /> across all of said vacated property; and <br /> WHEREAS, the City of Everett further retained the right to grant to <br /> public and private utilities the right to construct, operate, maintain, repair <br /> and replace utility lines, including but not limited to telephone, gas and <br /> electrical, under, over and across all of said vacated property; and <br /> WHEREAS, the City of Everett has been requested to relinquish said <br /> rights of easement over of the vacated right of way by the owners of the <br /> abutting property; and <br /> WHEREAS, the City of Everett finds that said rights of easement are not <br /> required in the forseeable future for either public or private utilities; <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT, WASHINGTON, <br /> DOES ORDAIN: <br /> "Section 4: That the City of Everett retain an easement to construct, <br /> operate, maintain, repair and replace all public utilities under, over and <br /> across all of said vacated property.
