ORDINANCE NO. 13 0 3-8 6 <br /> AN ORDINANCE creating Adult Use Business <br /> Zoning by amending Ordinance No. 3572, Title <br /> 19 Everett Municipal Code. <br /> WHEREAS, the City Council finds that Council adopted Resolution <br /> No. 2768 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That Ordinance No. 3572 (Title 19 of the Everett <br /> Municipal Code (EMC)) is hereby amended by the addition of the following <br /> section entitled "Adult Use Businesses" which shall include the following: <br /> A. PURPOSE <br /> The purpose of this ordinance is to protect the general public <br /> health, safety and welfare of the citizenry of the City of Everett <br /> through the regulation of adult use businesses through zoning. The <br /> regulations set forth herein are intended to prevent crime, protect <br /> the City's retail trade, maintain property values, and generally <br /> protect and preserve the quality of the City's neighborhoods, <br /> business and commercial districts and the quality of urban life. <br /> B. DEFINITIONS <br /> For purposes of this ordinance the following definitions shall apply: <br /> 1. Adult Bookstore means a retail establishment in which: <br /> Twenty-five percent or more of the "stock in trade" consists of <br /> books, magazines, posters, pictures, periodicals or other <br /> printed material distinguished or characterized by an emphasis <br /> on matter depicting, describing or relating to "specified <br /> sexual activities" or "specified anatomical areas" as defined <br /> herein. <br /> "Stock in trade" for the purposes of this ordinance shall mean <br /> all books, magazines, posters, pictures, periodicals, or other <br /> printed material readily available for purchase, rental, <br /> viewing or use by patrons of the establishment excluding <br /> material located in any storeroom or other portion of the <br /> premises not open to patrons. <br /> 2. Adult Use Business means any live adult entertainment <br /> establishment, adult bookstore, adult retail store, adult <br /> panoram establishment, adult movie theater and adult mini <br /> theater, or any establishment which provides one or more of the <br /> activities listed herein. <br /> 3. Live Adult Entertainment Establishment means any building or <br /> portion of a building which contains any exhibition or dance <br /> wherein any employee or entertainer is unclothed or in such <br /> attire, costume, or clothing so as to expose to view any <br /> portion of the female breast below the areola, or male or <br />
