• <br /> • <br /> ORDINANCE NO. 1,?;?y -. <br /> AN ORDINANCE amending ORDINANCE NO. 1284-86 providing for <br /> the vacation of 43d Street from the alley east of <br /> Colby to east of Wetmore <br /> WHEREAS, the City Council of the City of Everett, did by Ordinance No. <br /> 1284-86, passed August 27th, 1986 vacate 43rd Street from the alley east of <br /> Colby Avenue to east of Wetmore Avenue; and <br /> WHEREAS, a condition of said vacation was that the City of Everett be <br /> compensated one half the appraised value ; and <br /> WHEREAS, City of Everett Resolution No. 1724 allows for property to be <br /> exchanged in lieu of compensation; and <br /> WHEREAS, it is in the interest of the City of Everett and General <br /> Telephone Company of the Northwest to exchange property; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> That Section 3 which reads: <br /> "Section 3: That this ordinance shall not become effective until the <br /> owners of the property abutting upon the street herein described have <br /> compensated the City of Everett in an amount equal to one-half the current <br /> appraised value of the reversionary interest of the area herein described. <br /> The abutting property owners shall have ninety (90) days following passage of <br /> this ordinance to exercise this vacation. Unless otherwise amended by City <br /> Council, this ordinance shall be null and void if the abutting property <br /> owner(s) fail to exercise this vacation within ninety (90) days following <br /> passage of this ordinance." <br /> Is amended to read: <br /> Section 3: That this ordinance shall not become effective until the <br /> owners of the property abutting upon the street herein described have conveyed <br /> to the City of Everett by Statutory Warranty Deed for street and utility <br /> purposes the following: <br />
