INTERLOCAL COOPERATIVE PURCHASING AGREEMENT Pursuant to RCW Chapter 28A320.080 and RCW chapter 39.34, and other provisions of the law, Edmonds School District No. 15 and the City of Everett, hereby agree to cooperative governmental purchasing upon the following terms and conditions: 1. The City of Everett, in contracting for the purchase of rotary mowing equipment bid titled: "16 foot Rotary Mower" dated November 10, 1998 agrees to extend said contract to the Edmonds School District No. 15 to the extent permitted by law and agreed upon by both parties. 2. Edmonds School District No. 15 accepts responsibility for the compliance with any additional or varying laws and regulations goveming purchases by or on behalf of the state agency in question. A purchase by Edmonds School District No. 15 shall be effected by purchase order from their agency directed to Western Equipment Distributors, Inc. or other party contracting to fumish equipment or services to Edmonds School District. 3. The City of Everett accepts no responsibility for the performance of any purchasing contract by Western Equipment Distributors, Inc. or any other contracting party, and accepts no responsibility for payment of the purchase price by the Edmonds School District. 4. Whenever Edmonds School District has contracted to bid on behalf of the City of Everett, the City of Everett may purchase items or services covered by the contract on the same terms and conditions as the Edmonds School District. The City of Everett will direct purchase orders to the vendor or other party contracting to fumish items or -services to Edmonds School District. The Edmonds School District accepts no responsibility for the payment of the purchase price by the City of Everett. 5. Both the Edmonds School District and the City of Everett reserve the right to contract independently for the purchase of any items or services, with or without notice to the other party. 6. This Agreement shall continue in force for a ten year period through the end of the school year 2007-08 or until cancelled by either party, which cancellation may be effected with or without notice to the other party.
