Section 1: That the following described right-of-way: <br /> That part of the Southeast quarter of the Southwest quarter <br /> of Section 18, Township 28 North, Range 5 East, W.M. , <br /> described as beginning at a point opposite Highway Engineer's <br /> Station (hereinafter referred to as HES) 76+14.17 on the Line <br /> Survey of SR 99, Everett City Limits - Broadway Street South <br /> Extension, and 100 feet Southeasterly therefrom; thence <br /> Northeasterly parallel with said Line Survey to a point <br /> opposite HES 76+61.45 thereon; thence Northwesterly to a <br /> point opposite said HES and 60 feet Southeasterly therefore; <br /> thence Southwesterly parallel with said Line Survey to a <br /> point opposite HES 76+28.38 thereon; thence Southwesterly to <br /> the point of beginning. <br /> ALSO, that part of the North half of the Southeast quarter of <br /> said Section, Township and Range, described as a strip of <br /> land 40 feet in width, lying Northwesterly of and contiguous <br /> to a line drawn parallel with and 60 feet Northwesterly, when <br /> measured at right angles and/or radially, from said Line <br /> Survey and between a line drawn Northwesterly at right angles <br /> from HES 82+00 on said Line Survey and a line drawn <br /> Northwesterly radially from HES 99+71.4 on said Line Survey. <br /> The specific details of which will be found on Sheets 3 and 4 <br /> of that certain plan entitled SR 99, Everett City Limits - <br /> Broadway Street South Extension on file in the Office of the <br /> Secretary of Transportation at Olympia, Washington, bearing <br /> date of approval of February 23, 1932. <br /> be and the same is hereby vacated pursuant to the conditions set forth in this <br /> ordinance. <br /> Section 2: That the City of Everett shall not be responsible nor liable <br /> for storm drainage runoff resulting from existing drainage patterns as <br /> established on City rights-of-way that may currently, or in the future, go <br /> over, under or across the above described street vacation. <br /> Section 3: That this ordinance shall not become effective until the <br /> owners of the property abutting upon the street herein described have <br /> compensated the State of Washinton in an amount equal to one-half the current <br /> appraised value of the p rea herein described. <br /> The abutting property owners shall have ninety (90) days following passage of <br /> this ordinance to exercise this vacation. Unless otherwise amended by City <br /> Council, this ordinance shall be null and void if the abutting property <br /> owner(s) fail to exercise this vacation within ninety (90) days following <br /> passage of this ordinance. <br /> Section 4: That this Ordinance shall not become effective until the City <br /> of Everett has been compensated for 1986 Leasehold Fees in the amount of <br /> $ 16,042.50 (sixteen thousand forty-two dollars and fifty cents) . Said fees <br /> to be payable within the same 90 (ninety) day period and with the same <br /> conditions as provided in Section 3, or the Lease is otherwise terminated. <br />
