Section 1: That the following described right-of-way: That part of the Southeast quarter of the Southwest quarter of Section 18, Township 28 North, Range 5 East, W.M. , described as beginning at a point opposite Highway Engineer's Station (hereinafter referred to as HES) 76+14.17 on the Line Survey of SR 99, Everett City Limits - Broadway Street South Extension, and 100 feet Southeasterly therefrom; thence Northeasterly parallel with said Line Survey to a point opposite HES 76+61.45 thereon; thence Northwesterly to a point opposite said HES and 60 feet Southeasterly therefore; thence Southwesterly parallel with said Line Survey to a point opposite HES 76+28.38 thereon; thence Southwesterly to the point of beginning. ALSO, that part of the North half of the Southeast quarter of said Section, Township and Range, described as a strip of land 40 feet in width, lying Northwesterly of and contiguous to a line drawn parallel with and 60 feet Northwesterly, when measured at right angles and/or radially, from said Line Survey and between a line drawn Northwesterly at right angles from HES 82+00 on said Line Survey and a line drawn Northwesterly radially from HES 99+71.4 on said Line Survey. The specific details of which will be found on Sheets 3 and 4 of that certain plan entitled SR 99, Everett City Limits - Broadway Street South Extension on file in the Office of the Secretary of Transportation at Olympia, Washington, bearing date of approval of February 23, 1932. be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. Section 2: That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may currently, or in the future, go over, under or across the above described street vacation. Section 3: That this ordinance shall not become effective until the owners of the property abutting upon the street herein described have compensated the State of Washinton in an amount equal to one-half the current appraised value of the p rea herein described. The abutting property owners shall have ninety (90) days following passage of this ordinance to exercise this vacation. Unless otherwise amended by City Council, this ordinance shall be null and void if the abutting property owner(s) fail to exercise this vacation within ninety (90) days following passage of this ordinance. Section 4: That this Ordinance shall not become effective until the City of Everett has been compensated for 1986 Leasehold Fees in the amount of $ 16,042.50 (sixteen thousand forty-two dollars and fifty cents) . Said fees to be payable within the same 90 (ninety) day period and with the same conditions as provided in Section 3, or the Lease is otherwise terminated.
