• <br /> 1 ORDINANCE NO. /,7 7/ —T <br /> 2 AN ORDINANCE relating to the riding of skateboards on sidewalks <br /> 3 and streets, adding a new section to Ordinance No. 459-77 (Model <br /> Traffic Ordinance) . <br /> 4 <br /> 5 WHEREAS, the riding of skateboards on busy sidewalks and streets is <br /> 6 inherently dangerous to both the rider and pedestrians; <br /> 7 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: NEW SECTION ADDED. A new section is hereby added to <br /> Ordinance No. 459-77 , to read as follows: <br /> 9 <br /> Skateboards - Riding on Sidewalks. <br /> 10 <br /> 1. Whenever any person is riding a skateboard upon a sidewalk, <br /> 11 such person shall yield the right-of-way to any pedestrian. <br /> 12 2. No person shall ride a skateboard upon a public sidewalk or <br /> roadway in a business district. <br /> 13 <br /> 3. Violation of any provision of this section is a traffic <br /> 14 infraction. <br /> 15 4. "Business district," as used in this section, means any <br /> area designated by the Everett Zoning Code (EMC Title 19) , <br /> 16 as now or hereafter amended, as Zone B-1, B-2 (A) , B-2(B) , <br /> B-3, C-1, or C-2. <br /> 17 <br /> 18 Section 2: SEVERABILITY CLAUSE. If any provision of this ordinance <br /> or its application to any person or circumstance is held invalid, the <br /> 19 remainder of the ordinance, or the application of the provision to other <br /> 20 persons or circumstances, is not affected. <br /> 21 Section 3: GENERAL DUTY. Nothing in this ordinance is intended to <br /> create a cause of action or claim against the City or its officials or <br /> 22 employees running to specific individuals.
