To be in possession of any shopping cart that has been removed from the parking area of a retail establishment 2 with the intent to deprive the owner of the shopping cart the use of the cart. 3 2. This section shall apply only when a shopping cart: (a) Has a sign 4 permanently affixed to it that identifies the owner of the cart or the retailer, or both; (b) notifies the public of the procedure to be 5 utilized for authorized removal of the cart from the premises; (c) notifies the public that the unauthorized removal of the cart from 6 the premises or parking area of the retail establishment, or the unauthorized possession of the cart, is unlawful; and (d) lists a 7 telephone number or address for returning carts removed from the premises or parking area to the owner or retailer. 8 3. Any person who violates any provision of this section is guilty of a 9 misdemeanor. 10 Section 3: Severability. If any one or more of the sections or provisions 11 provided in this ordinance shall be declared by any court of competent jurisdiction to be 12 contrary to law, then such sections or provisions shall be null and void and shall be 13 deemed separable from the remaining sections or provisions in this ordinance and shall 14 in no way affect the validity of the remaining sections or provisions in this ordinance. 15 Section 4: General Duty. Nothing in this ordinance is intended to create a 16 cause of action or claim against the City or its officials or employees running to 17 specific individuals.
