• <br /> • <br /> • <br /> 1 b. To be in possession of any shopping cart that has been <br /> removed from the parking area of a retail establishment <br /> 2 with the intent to deprive the owner of the shopping cart <br /> the use of the cart. <br /> 3 <br /> 2. This section shall apply only when a shopping cart: (a) Has a sign <br /> 4 permanently affixed to it that identifies the owner of the cart or <br /> the retailer, or both; (b) notifies the public of the procedure to be <br /> 5 utilized for authorized removal of the cart from the premises; (c) <br /> notifies the public that the unauthorized removal of the cart from <br /> 6 the premises or parking area of the retail establishment, or the <br /> unauthorized possession of the cart, is unlawful; and (d) lists a <br /> 7 telephone number or address for returning carts removed from the <br /> premises or parking area to the owner or retailer. <br /> 8 3. Any person who violates any provision of this section is guilty of a <br /> 9 misdemeanor. <br /> 10 <br /> Section 3: Severability. If any one or more of the sections or provisions <br /> 11 <br /> provided in this ordinance shall be declared by any court of competent jurisdiction to be <br /> 12 <br /> contrary to law, then such sections or provisions shall be null and void and shall be <br /> 13 deemed separable from the remaining sections or provisions in this ordinance and shall <br /> 14 <br /> in no way affect the validity of the remaining sections or provisions in this ordinance. <br /> 15 <br /> Section 4: General Duty. Nothing in this ordinance is intended to create a <br /> 16 <br /> cause of action or claim against the City or its officials or employees running to <br /> 17 <br /> specific individuals.
