] ORDINANCE NO. ^ <br /> 2 <br /> AN ORDINANCE relating to dangerous dogs, amending Section 2 of <br /> 3 Ordinance No. 1228-86, and adding a new section to Ordinance No. <br /> 1228-86. <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: That Section 2 of Ordinance No. 1228-86, which reads as follows: <br /> 7 <br /> 8 Section 2: Definitions. As used in this chapter: <br /> 9 A. "Owner" means any person or legal entity having a possessory <br /> property right in a dog or who harbors, cares for, exercises control <br /> 10 over, or knowingly permits any animal to remain on premises <br /> occupied by them. <br /> 11 <br /> B. "Dangerous dog" means: <br /> 12 <br /> 1. Any dog with a known propensity, tendency, or disposition to <br /> 13 attack unprovoked, to cause injury to, or to otherwise <br /> endanger the safety of humans or other domestic animals; or <br /> 14 <br /> 2. Any dog which attacks a human being or other domestic <br /> 15 animal without provocation. <br /> 16 C. A dangerous dog is "unconfined" if such dog is not securely <br /> confined indoors or confined in a securely enclosed and locked pen <br /> 17 or structure upon the premises of the owner of such dog. Such pen <br /> or structure must have secure sides and a secure top. If the pen or <br /> 18 structure has no bottom secured to the sides, the sides must be <br /> embedded into the ground no less than one foot. <br /> 19 <br /> 20 is hereby amended to read as follows: <br /> 21 <br /> Section 2: Definitions. As used in this chapter: <br /> 22 <br /> A.
