I <br /> • <br /> 1 <br /> In the event that such person cannot be served personally <br /> 2 in the City of Everett, then such Fire Marshal Order may be <br /> served by delivering to and leaving with any person in <br /> 3 charge of the premises a copy of such order, and by mailing <br /> a copy of such order in an envelope with postage prepaid, <br /> 4 addressed to the last known post office address of such <br /> individual. <br /> 5 In the event that no person can be found in charge of the <br /> 6 premises, then such order may be served upon any of the <br /> persons or parties herein set forth by affixing or posting <br /> 7 a copy of such order to the premises and by mailing a copy <br /> of such order to such named individual in an envelope <br /> 8 addressed to such person, with postage prepaid thereon, to <br /> such individual' s last known post office address. <br /> 9 <br /> 3. If the buildings or other premises are owned by one person <br /> 10 and occupied by another under a lease or leasehold <br /> agreement or otherwise, the orders issued in connection <br /> 11 herewith shall apply to the occupant or tenant thereof, <br /> provided that if the person on whom the order is served is <br /> 12 a tenant or occupying such premises under a lease or <br /> leasehold agreement or otherwise, then such individual <br /> 13 shall be deemed to have complied with the Fire Marshal <br /> Order if the said tenant or lessee immediately closes and <br /> 14 secures such a building, causes said premises after receipt <br /> of such Fire Marshal Order and takes such steps as may be <br /> 15 reasonable to remove accumulations of combustible, <br /> explosive or otherwise hazardous materials. <br /> 16 <br /> 4. Any such Fire Marshal Order shall be forthwith complied <br /> 17 with as set forth in said order within the time or times <br /> therein prescribed. Any person upon whom such order is <br /> 18 served, may take an appeal of such order and seek review <br /> thereof with the Board of Appeals, provided such appeal is <br /> 19 filed within thirty (30) calendar days after service of <br /> such order. <br /> 20 <br /> 5. In the event that any such person seeking a review before <br /> 21 the Board of Appeals fails to comply with all of the steps <br /> herein set forth, then any member of said Board of Appeals <br /> 22 or the City Attorney for the City of Everett may dismiss <br /> such appeal upon motion and if all of the steps for appeal <br /> 23 have not been complied with, the appeal of such party shall <br /> be dismissed by the Board of Appeals. All decisions of the <br /> 24 Board of Appeals shall be final. <br /> 25 <br /> E. Section 78.102(b) of the 1985 Edition of the UFC is hereby <br /> 26 <br /> amended by deleting: <br /> 27 <br /> 28 (b) Except as hereinafter provided, it shall be unlawful for <br /> any person to possess, store, to offer for sale, expose for sale, <br /> 29 sell at retail or use or explode any fireworks, provided that the <br /> chief shall have power to adopt reasonable rules and regulations <br /> 30 for the granting of permits for supervised public displays of <br /> fireworks by a jurisdiction, fair associations, amusement parks, <br /> 31 other organizations or for the use of fireworks by artisans in <br /> pursuit of their trade.
