. • <br /> 1 , <br /> 1 ORDINANCE NO, Ca 4J_F6 <br /> 2 <br /> AN ORDINANCE adopting the State Energy Code and repealing Ordinance <br /> 3 No. 727-80. <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1: The State Energy Code, Chapter 51-12 Washington Administrative <br /> 7 Code, is hereby adopted by reference except for such portions as are modified or <br /> 8 amended by this ordinance. <br /> 9 Section 2: Amendments Made In The State Energy Code. <br /> 10 A. WAC 51-12-102, Scope of the Washington State Energy Code, is hereby <br /> 11 amended by the addition of the following language: <br /> 12 <br /> 13 (c) Residences Built to More Stringent Standards. <br /> Single family residences (including duplexes) which are built to standards <br /> 14 found in the Super Good Cents Technical Reference Manual or the Model <br /> 15 Conservation Standards adopted by the Regional Power Planning Council <br /> shall be equipped with an air-to-air heat exchanger. <br /> 16 The air-to-air heat exchanger system shall comply with the requirements <br /> of the latest version of the Bonneville Power Administration's Installation <br /> 17 and Operations Guidelines for Air-to-Air Heat Exchangers. <br /> 18 <br /> B. The State Energy Code is hereby amended by the addition of the <br /> 19 <br /> following: <br /> 20 <br /> 21 Authority to Abate <br /> 22 a. Any violation of the Code is hereby declared to be a nuisance. <br /> 23 b. Where a nuisance exists, the City Attorney on behalf of the City is <br /> 24 authorized to institute an injunction, mandamus, or other <br /> appropriate action or proceeding to prevent the violation of this <br /> 25 Code. <br /> 26 c. Notwithstanding paragraph (b), the City Attorney is authorized to <br /> apply to any court of competent jurisdiction for and such court, <br /> 27 upon hearing and for cause shown, may grant a temporary or <br /> permanent injunction restraining any person, firm and/or corpora- <br /> tion28 from violating any provision of this Code and compelling <br /> compliance herewith. The cost of such action shall be taxed <br /> 29 against the violator. <br /> 30 d. A conviction of any person, firm or corporation for violating this <br /> Code shall not impede the authority granted in this section to the <br /> 31 City Attorney or City. <br /> 32 <br />
