1 ORDINANCE NO. /C27 -- <br /> 2 <br /> c c -2 AN ORDINANCE amending Section 5(C) of Ordinance No. 4041, the <br /> City of Everett Sign Code. <br /> 3 <br /> 4 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 5 <br /> Section 1: That Section 5(C) of Ordinance No. 4041, EMC 16. 16.060(C) , <br /> 6 <br /> which reads as follows: <br /> 7 <br /> 8 C. Horizontal and Vertical Clearances. - No sign shall be <br /> located closer than eight (8) feet to any electrical or <br /> 9 telephone conductor without written approval of both the <br /> Electrical Inspector and the Superintendent of the <br /> 10 Communications Department. EXCEPTION: Under no <br /> circumstances shall permission be granted to locate a sign <br /> 11 closer than eight (8) feet to a 12 KV power conductor. <br /> All energized wires located closer than eight (8) feet to <br /> 12 any part of the proposed sign or structure shall be shown <br /> on the plan submitted by the applicant. <br /> 13 <br /> 14 be and the same is hereby amended to read as follows: <br /> 15 <br /> C. Horizontal and Vertical Clearances - No sign or sign <br /> 16 structure shall be located closer to a power conductor or <br /> telephone conductor than the minimum horizontal and <br /> 17 vertical clearance distance established by the Snohomish <br /> County PUD for power conductors and the General Telephone <br /> 18 Company for telephone conductors. Prior to the issuance <br /> of any sign permit by the City, the applicant shall obtain <br /> 19 and present to the City written approval from the <br /> Snohomish County PUD and General Telephone Company stating <br /> 20 that the sign and sign structure meet their horizontal and <br /> vertical clearance standards. <br /> 21 <br /> 22 Section 2: Severability. <br /> 23 If any provision of this ordinance shall be declared unconstitutional <br /> 24 or invalid by any court of competent jurisdiction, it shall be conclusively <br /> 25 presumed that this ordinance would have been enacted without the provision <br /> 26 so held unconstitutional or invalid and the remainder of this ordinance <br /> 27 / / / / / <br /> 28 / / / / / <br /> 29 / / / / / <br /> 30 / / / / / <br /> 31 / / / / / <br /> 32 / / / / / <br />
