1 ORDINANCE NO. /C27 -- 2 c c -2 AN ORDINANCE amending Section 5(C) of Ordinance No. 4041, the City of Everett Sign Code. 3 4 THE CITY OF EVERETT DOES ORDAIN: 5 Section 1: That Section 5(C) of Ordinance No. 4041, EMC 16. 16.060(C) , 6 which reads as follows: 7 8 C. Horizontal and Vertical Clearances. - No sign shall be located closer than eight (8) feet to any electrical or 9 telephone conductor without written approval of both the Electrical Inspector and the Superintendent of the 10 Communications Department. EXCEPTION: Under no circumstances shall permission be granted to locate a sign 11 closer than eight (8) feet to a 12 KV power conductor. All energized wires located closer than eight (8) feet to 12 any part of the proposed sign or structure shall be shown on the plan submitted by the applicant. 13 14 be and the same is hereby amended to read as follows: 15 C. Horizontal and Vertical Clearances - No sign or sign 16 structure shall be located closer to a power conductor or telephone conductor than the minimum horizontal and 17 vertical clearance distance established by the Snohomish County PUD for power conductors and the General Telephone 18 Company for telephone conductors. Prior to the issuance of any sign permit by the City, the applicant shall obtain 19 and present to the City written approval from the Snohomish County PUD and General Telephone Company stating 20 that the sign and sign structure meet their horizontal and vertical clearance standards. 21 22 Section 2: Severability. 23 If any provision of this ordinance shall be declared unconstitutional 24 or invalid by any court of competent jurisdiction, it shall be conclusively 25 presumed that this ordinance would have been enacted without the provision 26 so held unconstitutional or invalid and the remainder of this ordinance 27 / / / / / 28 / / / / / 29 / / / / / 30 / / / / / 31 / / / / / 32 / / / / /
