• 1 Section 58: Construction Water Use for Public Works. 2 In the case of public works contracts, such as installation of sewers 3 and other utilities involving construction in the public streets on 4 easements and rights-of-way, all water used in connection therewith for such 5 work as water-settling backfill or earthwork, hydraulic testing of pipe or 6 structures, flushing of pipes or street surface for cleanup, mixing or 7 curing concrete and similar water uses, shall be obtained from the water 8 system only at the locations and in the manner specified by the 9 Superintendent in accordance with procedures established by the Utilities 10 Superintendent. All water so used shall be paid for by the contractor at 11 the applicable metered rate. In the absence of a metered record of the 12 water use, the Utilities Superintendent shall estimate the amount of water 13 used and the charge for same shall be rendered to the contractor 14 accordingly. The charges for water shall be considered to operate as a 15 materials lien against the contractor if unpaid. A reasonable meter rental 16 charge for use of any meter furnished by the Utilities Division to measure 17 water used in connection with the contracts may be added to the billing for 18 water consumed including repair of any damage done to the meter. 19 Section 59: Construction Water Use for Buildings. 20 A. Metered. In the case of water consumed during construction of a building or structure which, upon completion, would be served through a 21 metered connection, the amount of water so consumed during construction shall be paid for by the contractor or owner at the applicable metered 22 rate. If a metered service is not installed to the premises during the initial stage of construction, the amount of water consumed between the 23 commencement of construction and the installation and turn-on of the metered service shall be estimated by the Utilities Superintendent and 24 the charge added to the cost for installation of the service connection, or added to a subsequent water billing to the premises. 25 B. Fixed Rate. In the case of water consumed during construction of a 26 residence which, upon completion, would be eligible for a fixed rate service, there shall be no charge other than the fixed rate charge, 27 provided the service connection is installed and turned on during the initial stage of construction. 28 Section 60: Special Water Use--Approval Required. 29 Any and all other special uses of water from the water system not 30 included above nor elsewhere in this chapter shall be reviewed prior to such 31 use and the requirements and charges applicable to such special use of water 32 shall then be determined by the Utilities Superintendent. 24
