• <br /> 1 Section 58: Construction Water Use for Public Works. <br /> 2 In the case of public works contracts, such as installation of sewers <br /> 3 and other utilities involving construction in the public streets on <br /> 4 easements and rights-of-way, all water used in connection therewith for such <br /> 5 work as water-settling backfill or earthwork, hydraulic testing of pipe or <br /> 6 structures, flushing of pipes or street surface for cleanup, mixing or <br /> 7 curing concrete and similar water uses, shall be obtained from the water <br /> 8 system only at the locations and in the manner specified by the <br /> 9 Superintendent in accordance with procedures established by the Utilities <br /> 10 Superintendent. All water so used shall be paid for by the contractor at <br /> 11 the applicable metered rate. In the absence of a metered record of the <br /> 12 water use, the Utilities Superintendent shall estimate the amount of water <br /> 13 used and the charge for same shall be rendered to the contractor <br /> 14 accordingly. The charges for water shall be considered to operate as a <br /> 15 materials lien against the contractor if unpaid. A reasonable meter rental <br /> 16 charge for use of any meter furnished by the Utilities Division to measure <br /> 17 water used in connection with the contracts may be added to the billing for <br /> 18 water consumed including repair of any damage done to the meter. <br /> 19 Section 59: Construction Water Use for Buildings. <br /> 20 A. Metered. In the case of water consumed during construction of a <br /> building or structure which, upon completion, would be served through a <br /> 21 metered connection, the amount of water so consumed during construction <br /> shall be paid for by the contractor or owner at the applicable metered <br /> 22 rate. If a metered service is not installed to the premises during the <br /> initial stage of construction, the amount of water consumed between the <br /> 23 commencement of construction and the installation and turn-on of the <br /> metered service shall be estimated by the Utilities Superintendent and <br /> 24 the charge added to the cost for installation of the service <br /> connection, or added to a subsequent water billing to the premises. <br /> 25 <br /> B. Fixed Rate. In the case of water consumed during construction of a <br /> 26 residence which, upon completion, would be eligible for a fixed rate <br /> service, there shall be no charge other than the fixed rate charge, <br /> 27 provided the service connection is installed and turned on during the <br /> initial stage of construction. <br /> 28 <br /> Section 60: Special Water Use--Approval Required. <br /> 29 <br /> Any and all other special uses of water from the water system not <br /> 30 <br /> included above nor elsewhere in this chapter shall be reviewed prior to such <br /> 31 <br /> use and the requirements and charges applicable to such special use of water <br /> 32 <br /> shall then be determined by the Utilities Superintendent. <br /> 24 <br />
