• <br /> 1 <br /> Section 6: System Alterations Caused by Improvements. <br /> 2 <br /> In the event it becomes necessary to relocate or change the alignment <br /> 3 <br /> or grade of a lateral or feeder line, service connection, fire hydrant or <br /> 4 <br /> other water facility by reason of construction of improvements, including, <br /> 5 <br /> but not limited to paving, sidewalks, curb and gutter, regrades, street <br /> 6 <br /> lights, construction or modification to other utilities, or similar <br /> 7 <br /> construction or changes, such alterations to the water system shall be <br /> 8 <br /> performed by the Utilities Division (unless prior written authorization is <br /> 9 <br /> given by the Utilities Superintendent for reconstruction by others) and paid <br /> 10 <br /> for by the local improvement district, utility, person, firm or corporation <br /> 11 <br /> responsible for or causing such alteration. <br /> 12 <br /> Section 7: System Facilities Installation and Ownership. <br /> 13 <br /> A. The ownership of all water mains, extensions thereof, fire hydrants, <br /> 14 services and all related appurtenances located in public streets and <br /> utility easements or rights-of-way, shall be vested solely in the <br /> 15 Utilities Division. Any developer, person, firm or corporation having <br /> an interest in the construction and/or payment for such water mains, <br /> 16 extensions, fire hydrants, services and related appurtenances shall <br /> relinquish interest upon acceptance of the facilities by the Utilities <br /> 17 Division. Relinquishment of such facilities shall be a prerequisite to <br /> the Utilities Division supplying water to facilities located within the <br /> 18 City limits. <br /> 19 B. The Utilities Division shall install all distribution mains and <br /> appurtenances within the City unless specifically agreed otherwise in <br /> 20 writing or required by law. The Utilities Division shall maintain and <br /> operate water mains, facilities and appurtenances owned by the City. <br /> 21 <br /> Section 8: Basic Types of Water Service. <br /> 22 <br /> There shall be two basic types of water service provided within the <br /> 23 <br /> City limits, namely "fixed rate" service and "metered" service. <br /> 24 <br /> Section 9: Fixed Rate Service. <br /> 25 <br /> The customers or premises furnished fixed rate water service shall be <br /> 26 <br /> those single unit dwellings located within the City limits, having a water <br /> 27 <br /> service pipe diameter not larger than three-fourths of an inch. No single <br /> 28 <br /> unit dwelling which is used or occupied in part by an office, commercial <br /> 29 <br /> enterprise or home occupation of any type shall be eligible for a fixed rate <br /> 30 <br /> water service. <br /> 31 <br /> 32 <br /> 4 <br />
