• <br /> • <br /> • <br /> • <br /> • • • <br /> 1 Appeals. <br /> 2 Any applicant who has had his or her residential parking zone permit <br /> application denied is entitled to appeal the denial to the City of Everett <br /> 3 Parking Hearing Examiner provided a written appeal is filed with the City <br /> Clerk within ten (10) days following the date of denial. Any permittee <br /> 4 who has had his/her residential parking zone permit revoked is entitled to <br /> appeal the revocation to the City's Parking Hearing Examiner provided <br /> 5 the permittee files a written appeal with the City Clerk within ten (10) <br /> days following the date of revocation. The Parking Hearing Examiner <br /> 6 may, in its discretion, affirm, nullify or modify the denial or revocation. <br /> 7 <br /> Section 3: Ordinance No. 544-78 is hereby amended by the addition of the <br /> 8 <br /> following section: <br /> 9 <br /> 10 Rules and Regulations. <br /> 11 The City Clerk and the Traffic Engineer are hereby authorized to <br /> promulgate rules and regulations necessary to administer the City's <br /> 12 residential permit parking zone ordinance. <br /> 13 <br /> Section 4: Section 15 of Ordinance No. 544-78 is hereby repealed. <br /> 14 <br /> Section 5: Subsection 3 of Section 17 of Ordinance No. 544-78 which reads as <br /> 15 <br /> follows: <br /> 16 <br /> 17 The offenses defined herein this ordinance shall be Class B offenses as <br /> defined in Chapter 10 of the Everett Municipal Code. <br /> 18 <br /> 19 Be and the same is hereby amended to read as follows: <br /> 20 <br /> 21 Any person who violates this ordinance shall be guilty of a misdemeanor <br /> and on conviction therefor may be punished by a fine not to exceed <br /> 22 $1,000. <br /> 23 Section 6: If any section, clause, sentence or phrase of this ordinance shall be <br /> 24 held invalid or unconstitutional, the invalidity or unconstitutionality shall not affect the <br /> 25 validity or constitutionality of any other section, clause, sentence or phrase. <br /> 26 <br /> 27 WILLIAM E.
