• <br /> WHEREAS, the Everett City Council held a public hearing and approved <br /> the Planning Commission's recommendation to adopt said Addendum to the <br /> Concomitant Agreement; and <br /> WHEREAS, the Owner has agreed to develop the aforementioned property <br /> in accordance with the Concomitant Agreement dated January 22, 1986, and <br /> this Addendum to the Concomitant Agreement. <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> I. That Conditions 7 and 8 of the Concomitant Agreement dated <br /> January 22, 1986, for the Alan Johnson Rezone #9-84 are hereby <br /> amended to read as follows: <br /> Condition #7. All structures shall be setback a <br /> minimum of 40 feet from the <br /> residentially zoned property. <br /> Any residential structures shall be set <br /> back a minimum of 40 feet from the <br /> nearest residentially zoned property <br /> with the exception of the easterly <br /> property line where the setback will be <br /> a minimum of 7 feet and the development <br /> shall be permitted at a density of 381 <br /> dwelling units or less with a maximum <br /> of 60% two bedroom units. <br /> Condition #8. All structures on the subject property <br /> shall be limited to a maximum height of <br /> 25 feet. In the area adjacent to the <br /> mobile homepark 40 to 100 feet from the <br /> perimeter of the parcel, no building <br /> shall exceed 15 feet in height. <br /> Any residential structures on the <br /> subject property shall be limited to a <br /> maximum height of 40 feet with a <br /> maximum of three stories with a highly <br /> sloped roof with no buildings to be <br /> located within 100 feet of the north <br /> property line adjacent to the mobile <br /> home park. <br /> II. That the Concomitant Agreement is hereby amended by the <br /> addition of the following language: "The development shall <br /> occur according to the site plan prepared on May 2, 1989 by <br /> Charles Morgan and Associates that is currently being reviewed <br /> through the detailed site plan review process identified in <br /> Section 2 of the original Concomitant Agreement." <br /> III. That all provisions of the Concomitant Agreement other than <br /> those which are modified by Section I of this Agreement shall <br /> remain in full force and effect. <br /> -2- <br />
