1 ` <br /> , l• l <br /> JOHNSON REZONE <br /> CONCOMITANT AGREEMENT TO REZONE <br /> ORDINANCE NO. /.7./a5-4, <br /> ��77��11 <br /> THIS AGREEMENT is made and entered this circa day of /14za.417'', <br /> 1986, by Alan Johnson, said party being hereinafter referred to as Owner, and <br /> the City of Everett, a municipal corporation under the laws of the State of <br /> Washington, hereinafter referred to as the City; <br /> WITNESSETH: <br /> WHEREAS, ALAN JOHNSON is owner of a tract of real property <br /> approximately 13.6 acres in size located north of Everett Mall Way, east of <br /> the P.U.D. right-of-way (north of 92nd Street S.E. if extended) , Everett, <br /> Snohomish County, Washington, the legal description of which is attached <br /> hereto as Exhibit A and incorporated herein by this reference; and <br /> WHEREAS, such zoning and development is in close proximity to Everett <br /> Mall Way and will provide a substantial amount of needed commercial, office, <br /> or multiple family housing; <br /> WHEREAS, the public health, safety, and welfare would be best served by <br /> anticipating the impact of such development and imposing certain mutually <br /> agreed upon standards, conditions and requirements which shall be documented <br /> herein and hereafter considered to be an integral part of the zoning <br /> restrictions applicable to the property; and <br /> WHEREAS, the Owners has agreed to develop the aforementioned property <br /> per the provisions of this Agreement in consideration of the City considering <br /> designating the property C-1 and the Owner further has agreed as part of said <br /> consideration that should the City zone the property C-1, to lay out, develop, <br /> and maintain the property as hereinafter set forth; <br /> 1663F <br /> CONCOMITANT AGREEMENT - 1 <br />
