/ <br /> , <br /> • <br /> j ORDINANCE NO. 12 ,`/ E'D�. <br /> 2 <br /> AN ORDINANCE establishing regulations regarding compensatory time. <br /> 3 <br /> 4 <br /> WHEREAS, FLSA and PERS time reporting requirements require closer <br /> 5 <br /> monitoring of the use of compensatory time by City employees; <br /> 6 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 7 <br /> Section 1: All employees shall take compensatory time within the month in <br /> 8 <br /> which it is accrued. <br /> 9 <br /> Section 2: An employee must receive prior approval from his/her supervisor <br /> 10 <br /> before accruing or using compensatory time. <br /> 11 <br /> Section 3: For FLSA non-exempt employees: <br /> 12 <br /> 13 A. Compensatory time shall be at time and one-half for work in <br /> excess of an eight (8) hour day for workers so scheduled, a ten (10) <br /> 14 hour day for workers so scheduled or a twelve (12) hour day for <br /> employees so scheduled. <br /> 15 <br /> B. For non-uniformed employees compensatory time shall be at time <br /> 16 and one-half for work in excess of forty (40) hours in a work week. <br /> 17 C. For uniformed employees (fire and police) the work period shall be <br /> twenty-eight (28) days, and compensatory time off may be allowed <br /> 18 in lieu of overtime pay at the rate of one hour and one-half for <br /> each hour worked by Police Department personnel in excess of one <br /> 19 hundred seventy-one (171) hours during a twenty-eight (28) day <br /> work period or in excess of two hundred twelve (212) hours during a <br /> 20 twenty-eight (28) day work period for Fire Department personnel. <br /> 21 D. This ordinance shall not modify overtime compensation arrange- <br /> ments established under applicable collective bargaining agree- <br /> 22 meats, except where prohibited by FLSA. <br /> 23 <br /> Section 4: For FLSA exempt employees, compensatory time shall be at <br /> 24 <br /> straight time and shall only be considered for hours worked on holidays or in excess of <br /> 25 <br /> forty (40) hours in a work week. No compensatory time shall be allowed for <br /> 26 <br /> Department Heads. <br /> 27 <br /> Section 5: The Mayor shall administer compensatory time in coordination with <br /> 28 <br /> this ordinance and applicable bargaining unit agreements and FLSA. <br /> 29 <br /> 30 / / / / / <br /> 31 / / / / / <br /> 32 / / / / / <br />
