• • <br /> INFORMATION FOR DEVELOPER: <br /> The following information is provided for the developer's benefit. These are not SEPA conditions but <br /> are associated with other laws or requirements. All requirements are preliminary in nature, and are <br /> based upon the preliminary site plan and the ordinances in effect at time of submittal for SEPA review. <br /> The proposal must comply with all ordinances in effect at the time a complete building permit <br /> application is filed, including those not specifically set forth herein. Contact the Planning <br /> Department for information regarding appeals processes for the requirements listed in this document. <br /> If in the future this project is subdivided into additional lots,tracts or parcels using the Binding Site Plan <br /> process, the applicant is advised that some building code standards will be different. The applicant is <br /> encouraged to contact the City's Building Department, at (425)257-8810 to determine how these <br /> standards will apply. • <br /> Environmental Health <br /> The site is located within the Everett Smelter Site, where soils and groundwater typically contain <br /> arsenic, lead, or cadmium above state cleanup levels. The Everett Smelter Site Upland Area Final <br /> Cleanup Action Plan/Final Environmental Impact Statement (FCAP/FEIS, Ecology Nov. 1999, as <br /> amended), incorporated by reference and available at the City Planning department, describes and <br /> adequately analyzes the Everett Smelter Site conditions, land use, and cleanup plan, including protective <br /> measures ("institutional controls") to be used in areas where contamination may remain after cleanup. <br /> The proposed action is located on property where contaminated soils have not been remediated. <br /> To the extent contamination remains on the site, as defined by the Everett Smelter Site cleanup action <br /> plan, this SEPA determination is based on the private or public property owner(and tenant or operator if <br /> applicable)implementing the institutional controls applicable to the property. <br /> The Permittee shall: <br /> a. Follow the Snohomish Heath District Everett Smelter Site public health advisory guidelines for <br /> taking precautions when digging into or otherwise coming into contact with contaminated soils <br /> remaining on site; <br /> b. If contaminated soil is excavated and left on site (including, for example, from tree planting, fence <br /> posts, utilities, or foundations), cover this soil with at least two feet of clean soil and otherwise meeting <br /> the"soil profile"for the Everett Smelter Site; <br /> c. Not give away or dispose of excavated soil (off-site) that may be contaminated, except to a facility <br /> permitted to accept such soil, unless the Snohomish Health District or Washington State Department of <br /> Ecology agree otherwise; <br /> d. Not backfill new or substantially modified utility line trenches with contaminated soil, such that <br /> workers could become exposed in future maintenance,repair or replacement activities; and <br /> e. Comply with by any deed restriction that may have been placed on the property. <br /> Before starting construction, the permittee or its contractor shall consult with the Snohomish Health <br /> District (SHD) or Ecology if the permittee or its contractor needs any clarification on soil excavation, <br /> management and disposal, and any required sampling of on-site soil to assure that surface soils (top two <br /> feet) meet FCAP or other applicable Ecology or SHD standards, including the "soil profile" for the <br /> Everett Smelter Site. The permittee shall keep a record of any consultation. <br /> /S <br />
