1 40-27 BUILDING <br />ELECTRONIC DELIVERABLES POLICY <br />I <br />BRPH ARCHITECTS -ENGINEERS, INC. <br />G. Contractor shall ensure that its Subcontractors and all others to whom it <br />furnishes ED, to the extent of the work to be performed by each such recipient, <br />shall be bound to the Architect/Engineer by the terms of this Electronic <br />Deliverables Policy to the same extent the Contractor is bound to <br />Architect/Engineer. Contractor shall ensure that each recipient of ED from <br />Contractor or its Subcontractors preserves and protect the rights of <br />Architect/Engineer under this Electronic Deliverables Policy. Contractor further <br />agrees that Architect/Engineer may require Contractor, Subcontractors, and all <br />others to whom it furnishes ED, to execute an "Electronic Deliverables Release" <br />as a condition to the release of ED to such persons. <br />1.4 "RELEASE, ELECTRONIC DELIVERABLES" FORM <br />A. The "Electronic Deliverables Release" Form attached hereto as Exhibit A, <br />consists of Release Conditions, Policies, Items Requested, Reimbursable Costs <br />(if applicable), Payment, and Shipping information. Contractor's shall insure that <br />separate "Electronic Deliverables Release" forms are filled out and signed by the <br />Owner, Contractor, Subcontractors, Consultants, Vendors, and each other <br />person requesting the ED, after which (and prior to the commencement of the <br />work under the Agreement) the Release shall be delivered to Architect/Engineer. <br />B. Architect/Engineer reserves the right to charge for the ED.
