Date: From: (Name of Entity) Re: ' (Project Name & current revision level if applicable) ' (BRPH Project Number - See Title Block) (BRPH Cad Code - See Title Block) ' The undersigned recipient requests a license to use BRPH's Electronic Deliverables (ED) listed below and acknowledges its complete understanding and acceptance of the terms and conditions stated herein. tACKNOWLEDGEMENTS The Electronic Deliverables (ED) described herein are considered original designs of a building, ' structure, development, or site and are protected as an "architectural work" under Section 102 of the United States Copyright Act, 17 U.S.C., as amended. ED includes Project specifications, plans, drawing templates, miscellaneous documents and calculations pertaining to the Project, and derivative works all in machine readable form. Since most e-mail carriers are limited to 2 to 3 MB files, the transfer of ED will be limited to Compact Discs (CDs) or electronic transfer. Since the preparation and delivery of ED by CDs or electronic transfer require time and expense, and ' since the information included in the ED is copyrighted material, the undersigned may be charged by BRPH for this transmittal service. ED shall be delivered in the electronic formats currently used by BRPH. If additional formats are ' requested by the undersigned, they may be provided by BRPH at an additional cost. The undersigned understands that it shall be required to use "Autodesk Navisworks" project software to properly gain access to the ED. This Release is to be signed by the undersigned, and each of its subcontractors or vendors, and returned to BRPH with the applicable payment for the ED. RELEASE CONDITIONS The ED was prepared by BRPH solely for the purpose of the Project specified above. These ED are not intended or authorized for use on any other project. BRPH provides the ED with no warranty or guarantee, express, implied, or statutory, as to the accuracy, reliability, suitability, or fitness for a particular purpose or project. The undersigned understands that the ED delivered to the undersigned on CDs or electronically may vary from the information and data contained on paper copies.
