<br /> B. Definitions
<br /> 1. "Contaminated material" is defined as soil, water, free product, Underground
<br /> Storage Tanks (UST), buried abandoned utility lines containing residual or free
<br /> product, solid waste, treated wood waste, chemical containers, or other solid,
<br /> liquid,or gas substances with contamination levels above background levels.
<br /> 2. "Hazardous substances" shall mean those substances or materials defined in the
<br /> RCW 70.105, as amended.
<br /> 3. "Release" shall have the meaning as defined in RCW 173-303, as amended. '
<br /> 4. "Environmental laws" shall mean any applicable statute, law, ordinance, order,
<br /> consent decree, judgment, permit, license, code, covenant, deed, common law,
<br /> treaty, convention or other requirement pertaining to protection of the
<br /> environment, health or safety, natural resources, conservation, wildlife, waste
<br /> management or disposal, hazardous substances or pollution, including but not
<br /> limited to regulation of releases to air, land,water, and groundwater.
<br /> C. Execution
<br /> 1. Discovery of Contaminated Material
<br /> In the event that the CONTRACTOR, during the course of construction or during any '
<br /> other activities authorized under this contract, should encounter suspected contaminated
<br /> material or any other materials suspected of posing a threat to human health and the
<br /> environment, the CONTRACTOR shall notify the ENGINEER immediately and manage
<br /> according to requirements identified below.
<br /> 2. Discovery of Contaminated Soil
<br /> CONTRACTOR shall note evidence of contamination (odor, visual staining of soil, free
<br /> liquid product seeping from soil, sheen on groundwater etc.) and note location of
<br /> evidence on a sketch of the excavation and provide to the ENGINEER.
<br /> CONTRACTOR shall report the discovery to the ENGINEER immediately.
<br /> CONTRACTOR shall stop all excavation activities, and secure the site to prevent entry I
<br /> by the public. The excavation shall not be backfilled. Protect all open excavations with
<br /> berms, plates and fencing. CONTRACTOR may continue with work in other non-
<br /> contaminated areas.
<br /> CONTRACTOR shall assist ENGINEER in collecting sample(s) of suspected
<br /> contaminated media for testing and characterization. CONTRACTOR shall allow 21
<br /> days, at no cost to OWNER, for testing,results and instructions as to how to proceed with
<br /> contaminated materials.
<br /> The CONTRACTOR shall obtain a copy of an approved soil disposal/acceptance permit '
<br /> (Disposal/Treatment Facility requires transporter to have a copy of the permit.)
