The inability of the applicant to derive reasonable economic use of the property is <br /> not the result of actions by the applicant in subdividing the property or adjusting a <br /> boundary line, thereby creating the undevelopable conditions after the effective <br /> date of this article. <br /> 5. The proposal mitigates the impacts on the environmentally sensitive areas to the <br /> maximum extent possible. <br /> Conditional Use <br /> 1. That the proposed use is consistent with the policies of RCW 90.58.020 and <br /> Everett's Shoreline Master Program. <br /> 2. That the use will not interfere with the normal public use of public shorelines. <br /> 3. That the use of the site and design of the project will be compatible with other <br /> authorized uses in the area and with uses planned for the area under the <br /> comprehensive plan and Shoreline Master Program. <br /> 4. That the proposed use will cause no significant adverse effects to the shoreline <br /> environment in which it is to be located. <br /> 5. That the public interest suffers no substantial detrimental effect. <br /> CONCLUSIONS BASED ON FINDINGS <br /> 1. The Applicant requested approval of a Shoreline Permit, Conditional Use and a <br /> RUE for a project to be completed at 2102 Ross Avenue, Everett, Washington. <br /> The proposed project includes an addition of a 5,280 square foot wharf; a 12,650 <br /> square foot staging area; a 12,750 square foot office and shop building that <br /> would be added to an existing 45,000 square foot steel fabrication and storage <br /> facility; and reduction of a shoreline buffer through a reasonable use process. <br /> (finding 1) <br /> 2. The SMP designations for the subject property are Urban Mixed Industrial for the <br /> upland portion of the site and Aquatic Conservancy for the portion of the site that <br /> fronts the Snohomish River. The proposed uses are allowed in both these <br /> zones. (finding 4) <br /> 3. The proposal is subject to shoreline review. It is the intent of the Applicant to <br /> combine the subject property with the adjoining property for a continued <br /> operation of a steel fabrication facility. (findings 6, 7, 8, 9, 10, 11 and 12) <br /> 3. The relevant sections of the SMP for the instant request were identified. <br /> (finding 15) <br /> 4. The regulation requiring protection of archaeological interest uncovered during <br /> excavation or development has adequately been addressed. (finding 29) <br /> 5. The entire site is within a zone "AE" as designated on the Flood Insurance Rate <br /> Map. A Floodplain Development Permit will be required. (finding 24) <br /> 11; <br />
