WHEREAS, a SEPA environmental review was completed for the proposed amendments and a <br /> Final Determination of Non-Significance was issued on May 15, 2007; and <br /> WHEREAS, the Planning Commission held a public hearing to address the proposed changes <br /> and recommended approval of the amendments; and <br /> WHEREAS,the proposed revisions are consistent with the criteria for updating the Zoning text: <br /> 1. The proposed amendments are consistent with the applicable provisions of the Everett <br /> Comprehensive plan; and <br /> 2. The proposed amendments bear a substantial relation to public health, safety or welfare; <br /> and <br /> 3. The proposed amendments promote the best long term interests of the Everett <br /> Community. <br /> NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 3 of Ordinance No. 1847-92, as most recently amended by Ordinance 2994- <br /> 07 (EMC 19.4.020), is hereby amended by the addition of the following definitions: <br /> "Artist studio" means a space primarily used as a work room for at least one artist that <br /> may be open to the public for demonstrations, classes, and retail sales. Artists studios are <br /> generally for the purpose of painting, pottery (ceramics), sculpture, photography, <br /> cinematography, animation, or the making of music. <br /> "Open air market"means an outdoor market held on a regular basis, and at which groups <br /> of individual vendors sell new or used goods, produce, freshly prepared foods, handmade <br /> crafts, or other unique goods. Live entertainment may be provided. Open-air market <br /> shall not include outdoor display or sales associated with retail establishments that are <br /> principally located in indoor facilities, or motor vehicle dealerships. <br /> Section 2. Table 5.1 of Section 36 of Ordinance No. 2397-99, as most-recently amended by <br /> Ordinance 2923-06, (EMC 19.05), which reads as follows: <br /> 2 <br />
