D. The issuance or granting of a permit or approval of plans and/or <br /> specifications shall not be deemed or construed to be a permit for, or an <br /> approval of, any violation of any of the provisions of this Code or any <br /> other law or regulation. No permit presuming to give authority to violate <br /> or cancel the provisions of this Code shall be valid, except insofar as the <br /> work or use, which it authorized, is lawful. <br /> E. The issuance or granting of a permit or approval of plans and/or <br /> specifications shall not prevent the Building Official or designee from <br /> thereafter requiring the correction of errors in said plans and/or <br /> specifications or from preventing construction operation being carried on <br /> thereunder when in violation of this Code or of any other ordinance, law <br /> or regulation or from revoking any certificate of approval when issued in <br /> error. <br /> Section 5: Board of Review <br /> Chapter 1 of the 2006 Edition of the Uniform Plumbing Code is hereby amended <br /> by adding the following: <br /> BOARD OF REVIEW: For the purpose of determining suitable alternate <br /> materials, alternate types and methods of construction and reasonable <br /> interpretations regarding the Uniform Plumbing Code, any person aggrieved by <br /> an order or action of the Building Official who does not have an enforcement <br /> procedure pending pursuant to Chapter 1.20 EMC, may file a written request with <br /> the City Clerk requesting a determination by the Board of Review. The aggrieved <br /> party must file such request within thirty calendar days from the date of receipt of <br /> the written order and shall cause to be made at his own expense, any tests or <br /> research required to substantiate the request. The Board shall not have any <br /> authority to waive the requirements of this Code, but may approve plans and a <br /> time frame for bringing an existing building into compliance with this Code's <br /> requirements, provided that time frame does not exceed one year. <br /> Section 6: Table 1-1 deleted—Permit Fees <br /> Plumbing Permit Fees: Table 1-1, Plumbing Permit Fees, of the 2006 Edition of <br /> the Uniform Plumbing Code is hereby deleted. Plumbing permit fees are <br /> contained in the city fee resolution. <br /> Section 7: Chapter 12 deleted <br /> Chapter 12 deleted: The 2006 Edition of the Uniform Plumbing Code is hereby <br /> amended by deleting Chapter 12 of the code in its entirety. <br /> Section 8: Gas piping,water heaters, or vents for water heaters <br /> Notwithstanding any wording in the 2006 Edition of the Uniform Plumbing Code <br /> or the Uniform Plumbing Code Standards, neither the Uniform Plumbing Code <br /> nor the Uniform Plumbing Code Standards shall apply to the installation of gas <br /> piping, water heaters, or vents for water heaters. <br /> Section 9: Chapter 16 added—Lead contamination <br /> -3- <br />
